  1. Pirate Bay Loses New Domain Name, Hydra Lives On The Pirate Bay has lost one of its new domain names after an intervention from South Georgia's .GS registry. While the domain suspension wasn't unexpected and the proverbial Hydra has now lost one head, TPB says that it can easily grow some more. c1hUiNe.jpg Earlier this week the Stockholm District Court ordered the Pirate Bay’s .SE domains to be handed over to the Swedish state, arguing that they were linked to copyright crimes. The Pirate Bay was fully prepared for the negative outcome and quickly redirected its visitors to six new domain names. Since then the site has been accessible through the GS, LA, VG, AM, MN and GD domain names, without even a second of downtime. Marking the change The Pirate Bay updated its logo to the familiar Hydra logo, linking a TLD to each of the heads. However, we can now reveal that one head has already been chopped off. The site’s .GS domain name has been suspended by the registry, and ThePirateBay.gs is now listed as “ServerHold” and “Inactive.” The Pirate Bay informs us that the .GS domain has indeed been lost, which didn’t come as a complete shock. In fact, one of the reasons to move to six domains was to see which ones would hold up. “We have more domain names behind, if needed. We are stronger than ever and will defend the site to the end,” the TPB team tells us. At this point it’s unclear for how long the other domain names will remain available. Hoping to find out more, we reached out to the respective registries to discover their policies on domains being operated by The Pirate Bay. The Mongolian .MN registry informs TF that they will process potential complaints through ICANN’s Dispute Resolution Policy, suggesting that they will not take any voluntary action. The VG Registry referred us to their terms and conditions, specifically sections 3.4 and 7.2, which allow for an immediate termination or suspension if a domain infringes on the rights of third parties. However, it could not comment on this specific case. “We will review any complaint and act accordingly. Please understand that we cannot make any predictions based on theoretical options,” a VG Registry spokesperson says. It won’t be a big surprise if several more Pirate Bay domain names are suspended during the days and weeks to come. That’s a Whac-A-Mole game the site’s operators are all too familiar with now, but one that won’t bring the site to its knees. Source :- TorrentFreak

  7. Supergirl pilot leaks to torrent sites, six months early After escaping from the planet Krypton years ago, 24-year-old Kara Zor-El is embracing her superhuman abilities. Better known as Supergirl, her latest adventures were to be showcased in a CBS pilot scheduled to air this coming November. This morning and six months early, the much-anticipated pilot leaked online. After making an appearance as far back as 1958, Supergirl was intended to be a female counterpart to DC Comics’ Superman who first appeared 20 years earlier. While successful in her own right, she never quite reached the dizzy heights of the Clark Kent-based character. This yeah, however, the world is braced for the return of Supergirl in a new CBS TV series. Featuring Melissa Benoist (Glee, Homeland, Law and Order) as Kara Zor-El, an alien who has hidden her powers since escaping from Krypton, the show will see her transform into Supergirl and “the superhero she was meant to be.” After a commitment in September 2014, the series was officially picked up by CBS earlier this month. The pilot was scheduled to debut in November, but those plans have now massively unraveled after the episode leaked online, six months earlier than its planned debut. Two ‘Scene’ release groups – DiMENSiON and LOL – competed to premiere the title first this morning, with the latter beating the former by around 90 seconds. LOL’s version is a convenient 400mb so likely to become the most sought after copy. On the other hand DiMENSiON’s is more than 15 times the size, but for 1080p connoisseurs it’ll be worth the wait. Although it’s certainly possible that the pilot contains hidden watermarks, as far as visible identifiers go the 46 minute episode looks very clean. As illustrated by the image below, there are no tell-tale ‘property of’ warnings that are regularly seen on ‘screener’ copies of leaked movies. The leak of the pilot came as a complete surprise a couple of hours ago so download stats on BitTorrent sites are a currently quite modest 25,000 or so. However, given the anticipated media snowball effect during the day the number of downloads is likely to increase dramatically, probably to more than a million by this time tomorrow. The Supergirl leak comes just weeks after the first four episodes of the new series of Game of Thrones leaked online. That event triggered a piracy crazy that continues to this day. Whether more episodes of Supergirl will leak online in the days to come is unknown but in any event it seems likely that CBS will try to stem the current tide. The company is a prolific sender of DMCA takedown notices and regularly sends more than 100,000 each week to Google alone. Source torrentfreak.com

  11. Court orders israeli isps to block popcorn time websites Copyright holders around the world are doing everything in their power to stop Popcorn Time. Following the UK example, Israeli media companies have now obtained a court order requiring major ISPs to block Popcorn Time websites. In addition, the rightsholders are pondering whether to have the application's ports blocked as well, which may get messy. Branded a “Netflix for Pirates,” the Popcorn Time app quickly gathered a user base of millions of people over the past year. The application has some of the major media giants worried, including Netflix which sees the pirate app as a serious competitor to its business. Since Popcorn Time is powered by BitTorrent it is hard to stop the downloads directly, but copyright holders can go after the websites that offer the application. In Israel the local anti-piracy outfit ZIRA went down this route. The group, which represents several media companies, applied for an ex parte injunction ordering local Internet providers to block access to the websites of several Popcorn Time forks. This week the Tel Aviv court granted the application, arguing that the application does indeed violate the rights of copyright holders. The copyright holders are pleased with the outcome, which shows that services such as Popcorn Time are infringing even though they don’t host any files themselves. “The Popcorn Time software provides users with a service to stream and download content on the Internet, including Israeli movies and foreign movies and TV series with English subtitles, without having any permission from copyright holders to do so,” attorney Presenti told local media. The ISP blockades will prevent people from downloading Popcorn Time in the future. However, applications that have been downloaded already will continue to work for now. To address this, ZIRA’s lawyers say the are considering additional steps including the option to block the ports Popcorn Time uses. While that may be effective, it may also block other traffic, especially if the app switches to more common ports such as port 80. Israel is the second country to block access to Popcorn Time websites. Last month the UK High Court issued a similar order, which also targeted the domain names of various APIs the applications use. 12. Pirate Domain Seizures Are Easy in the United States It's taken more than two years for Swedish authorities to seize two key Pirate Bay domains but over in the United States the process is dramatically quicker. A TV company has just achieved similar aims against 11 'pirate' streaming domains after being granted a comprehensive ex parte restraining order by a Florida court. One the biggest piracy-related stories of the year broke this week after Swedish authorities succeeded in their quest to take over two key Pirate Bay domains. The court order, handed down Tuesday, will see ThePirateBay.se and PirateBay.se fall under the control of the Swedish government, provided no appeal is filed in the coming weeks. It’s been a long and drawn out process but given the site’s history, one with an almost inevitable outcome. Over in the United States and spurred on by ‘rogue’ sites such as TPB, much attention has been focused on depriving ‘pirate’ sites of their essential infrastructure, domains included. Just last week the MPAA and RIAA appeared before the House Judiciary Committee’s Internet subcommittee complaining that ICANN isn’t doing enough to deal with infringing domains. Of course, having ICANN quickly suspend domains would be convenient, but entertainment industry groups aren’t completely helpless. In fact, yet another complaint filed in the United States by TV company ABS-CBN shows how easily it is to take control of allegedly infringing domains. The architect of several recent copyright infringement complaints, in its latest action ABS-CBN requested assistance from the United States District Court for the Southern District of Florida. The TV company complained that eleven sites (listed below) have been infringing its rights by offering content without permission. To protect its business moving forward ABS-CBN requested an immediate restraining order and after an ex parte hearing, District Court Judge William P. Dimitrouleas was happy to oblige. In an order (pdf) handed down May 15 (one day after the complaint was filed) Judge Dimitrouleas acknowledges that the sites unlawfully “advertised, promoted, offered for distribution, distributed or performed” copyrighted works while infringing on ABS-CBN trademarks. He further accepted that the sites were likely to continue their infringement and cause “irreparable injury” to the TV company in the absence of protection by the Court. Granting a temporary order (which will become preliminary and then permanent in the absence of any defense by the sites in question) the Judge restrained the site operators from further infringing on ABS-CBN copyrights and trademarks. However, it is the domain element that provokes the most interest. In addition to ordering the sites’ operators not to transfer any domains until the Court advises, Judge Dimitrouleas ordered the registrars of the domains to transfer their certificates to ABS-CBN’s counsel. Registrars must then lock the domains and inform their registrants what has taken place. Furthermore, the Whois privacy protection services active on the domains and used to conceal registrant identities are ordered to hand over the site operators’ personal details to ABS-CBN so that the TV company is able to send a copy of the restraining order. If no active email address is present in Whois records, ABS-CBN is allowed to contact the defendants via their websites. Once this stage is complete the domain registrars are ordered to transfer the domains to a new registrar of ABS-CBN’s choosing. However, if the registrars fail to act within 24 hours, the TLD registries (.COM etc) must take overriding action within five days. The Court also ordered ABS-CBN’s registrar to redirect any visitors to the domains to a specific URL (http://servingnotice.com/BL4G47/index.html) which is supposed to contain a copy of the order. At the time of writing, however, that URL is non-functional. Also of interest is how the Court locks down attempts to get the sites running again. In addition to expanding the restraining order to any new domains the site operators may choose to move to, the Court grants ABS-CBN access to Google Webmaster Tools so that the company may “cancel any redirection of the domains that have been entered there by Defendants which redirect traffic to the counterfeit operations to a new domain name or website.” The domains affected are: freepinoychannel.com, lambingan.to, pinoymovie.to, pinoynetwork.to, pinoytambayan-replay.com, pinoytambayantv.com, tambaytayo.com, tvnijuan.net, phstream.com, streampinoy.info and tambayanatin.com. Despite the order having been issued last Thursday, at the time of writing all but one of the domains remains operational. Furthermore, and in an interesting twist, pinoymovie.to and pinoynetwork.to have already skipped to fresh domains operated by none other than the Swedish administered .SE registry.

  14. Google Fiber pushes automatic piracy fines to subscribers Google Fiber is allegedly acting as a conduit for automatic demands for money in relation to piracy and copyright infringement. Google Fiber, the high-speed broadband service, is quickly expanding across the United States. Touting speeds which leave current Internet offerings in the dust -- allowing consumers to enjoy up to 1 GB/ps -- the service has moved from its original pilot grounds in Kansas City and is expected to appear in Charlotte and Raleigh-Durham, NC along with Nashville, TN and Atlanta, GA later this year. Consumers are clamouring for broadband speeds up to 100 times faster than the national average, but may have a nasty shock if they plan to use the service in order to download content from file-sharing websites and torrent search engines which infringe upon intellectual copyright. As reported by TorrentFreak on Wednesday, the rollout of Google Fiber has potentially become a catalyst for an increase in targeted piracy notices. According to the publication, piracy notices are being automatically forwarded to users of Google Fiber, and not only include regular cease-and-desist warnings but controversial demands from companies such as Rightscorp and CEG TEK. Rightscorp, for example, recently filed a lawsuit against two Comcast customers who both ignored multiple notices -- 11 and 288 demands respectively -- which may result in damage settlements and attorney fees if the firm can prove its case. Demands for payment, often settled online, can range from $20 to several hundred dollars. The practice requires scrutiny. These notices do not simply alert the user that their connection is being used to download pirated material; instead, the standard DMCA takedown process is used and a demand for money issued without proof of identity of the infringer. However, an IP address is not legally linked to an individual, and those targeted by these notices may not be the ones downloading -- family, friends, or an insecure Wi-Fi network can all be at fault. Without definitive proof, a scary letter can still be enough to force subscribers to pay up. However, this can also mean customers are left out of pocket or terrified by the idea of a court case for no reason. In order to protect customers from this practice, a number of Internet Service Providers (ISPs), such as Verizon, do not forward settlement demands. Comcast forwards on the details of the infringement but does not often include settlement demands. According to a letter received by the publication, however, Google is one such ISP which does automatic forward on such demands. Within a letter sent to a subscriber, Google Fiber says: "Your Google Fiber service has been allegedly used to access or download infringing copyrighted material. We have not shared any information about you with the complaining party, nor will we unless we receive a subpoena or are otherwise required by law to do so. Please be aware, however, that our Terms of Service forbid the use of your Google account for unlawful activities [..] repeated violations of our Terms of Service may result in remedial action being taken against your Google Fiber account, up to and including possible termination of your service." Below Google's notification is an automatic settlement demand sent by music licensing firm BMG, which says: "BMG will pursue every available remedy including injunctions and recovery of attorney's fees, costs and any and all other damages which are incurred by BMG as a result of any action that is commenced against you. While BMG is entitled to monetary damages from the infringing party [...] The BMG believes that it may be expeditious to settle this manner without the need of costly and time-consuming litigation. In order to help you avoid further legal action from BMG, we have been authorized to offer a settlement solution that we believe is reasonable for everyone." This appears to be a strange stance for Google to take, which now publicized, could end up turning off potential Fiber customers in support of ISPs which refuse to feed the piracy notice revenue model.

As on Kind of Blue (Columbia, 1959), for which the leader brought back pianist Bill Evans, Davis again turns to the past, this time calling upon two recent alumni to participate on three of the tracks. But far more than an historical document, Someday My Prince Will Come is a thing of beauty, an indispensable addition to the Davis recorded canon." - allaboutjazz.com nfck's Special Donor Pick Incurabili - Fair Enough Genre: Alternative, Punk-Blues Torrents: torrents.php?id=72735367 Review: The latest album by the quirky duo of frontmen is a step forward in their musical expression, where they move beyond their punk-blues roots toward a more contemporary sound, while retaining their raw power and rough sound. I'm not one that usually likes hip hop but Force Back to Sleep blew me away. It's a very raw and very emotional view on humanity wrapped up in harsh/dark electronic and poetic hip hop. Cubbiebear is brutally honest about his own feelings, flaws, and the world we live in. It sounds a little sappy but it's really quite 'fun' to listen to as well as its introspective qualities. 16. Pirate Bay seized by Swedish prosecutors & like the hydra it has spawned 6 new heads! The Swedish court has officially seized two key domains owned by notorious illegal BitTorrent file-sharing website Pirate Bay, but just like the mythical Greek monster Hydra, the website has spawned six more domains. The decision was made by the Stockholm District Court on 19 May and follows the continued campaign by Swedish prosecutor Frank Ingblad to bring down the Pirate Bay. In December 2014, Stockholm County Police raided a server room belonging to the website, seizing its servers and other equipment due to a complaint from a Swedish anti-piracy group. At the time, Ingblad said that the domains "piratebay.se" and "thepiratebay.se" should be placed under state control or even cancelled as they enable users to find it on the internet, and he alleged that the domain registrar Punkt SE was complicit in assisting users in committing copyright infringement. A long history of evading the law The Pirate Bay was founded in 2003 an online index of digital content of mostly entertainment media and none of its original co-founders are running the site anymore as most of them are in jail or have been to jail for copyright infringement offences. The community that now runs the website is used to having to come up with new solutions to keep it alive and escape detection from law enforcement, so it comes as no surprise that they had a plan up their sleeves. The team behind the Pirate Bay confirmed to TorrentFreak that both .SE addresses now redirect to one of six new domain names, which include piratebay.gs, piratebay.la, piratebay.vg, piratebay.am, piratebay.mn, and piratebay.gd. In typical thumbing-their-nose fashion, the homepage logo of the Pirate Bay has also been changed to feature a four-headed hydra behind the pirate ship, and the team says that the Swedish government has wasted the $40,000 (£25,780) in legal costs that the take-down operation rang up. "Congratulations to Prosecutor Fredrik Ingblad. Two years' hard work to get us to change two little letters at a cost of $20,000 per letter," the TPB team said. "He could have given us $35,000 and we would have left the domain, thus saving the Swedish tax payer $5,000. All he had to do was ask nicely." Shutting down piracy websites is a waste of time On 14 May, the European Commission's Joint Research Centre released new research showing that raiding and shutting down pirate websites is ultimately completely ineffective and a waste of time. Analysing the online consumption habits of 5,000 internet users in Germany from clickstream data gathered after the shutdown of the hugely popular German video streaming website kino.to in June 2011, the researchers found that there was only a 2.5% increase in users switching to legal online movie services. "Taken at face value, these results indicate that the intervention mainly converted consumer surplus into deadweight loss. If we were to take the costs of the intervention into account, our results would suggest that the shutdown of kino.to has not had a positive effect on overall welfare," the researchers wrote. In fact, the researchers said that raiding popular torrenting websites made the market much more fragmented, which then made it much harder for law enforcement to eradicate online piracy, if they had to go after many small domains instead of one big one.

  18. EZTV Alternatives: ETTV, YIFY Lead List Of Torrent Providers That Can Replace Sunken EZTV, the influential piracy site, walked the plank for the last time this week, 10 years after it began distributing torrent files of the most popular TV shows illegally. The site uploaded the TV files that were then aggregated by piracy behemoths like Kickass Torrents and the Pirate Bay. It should be no surprise, then, that EZTV's disappearance is already being felt across the global piracy ecosystem, leaving users scouring the Web for a viable replacement. EZTV was founded by a group of unknown pirate administrators frustrated by the recurrent need to find a new site when a reliable one would be taken down, either voluntarily or by law enforcement. Aside from regular domain changes and infrequent down time, EZTV operated largely in peace until it was one of the casualties of the police raid that knocked out the Pirate Bay, another legacy piracy site, in November 2014. EZTV returned weeks later, only to be compromised by a group of hackers who ultimately forced it to shut down for good Monday. The site still exists, but with new, untrusted operators who could be anyone from a group of Russian hackers to a copyright rights enforcement group posting bait files. The good news for piracy – and very bad news for copyright holders – is that EZTV was one of a number of services whose sole purpose was to upload pirated entertainment. EZTV was in many ways more important to the piracy world because it, like the alternative sites listed below, was where torrent files would first be uploaded before being picked up bigger players like Kickass and the Pirate Bay. Here's a brief list of sites that will continue that tradition: ETTV No, contrary to popular belief, EZTV and ETTV are not partners in crime. Yet the sites seemed to operate in a kind of implicit partnership: If one didn't offer the newest episode of “Game of Thrones” within an hour of the show's ending on HBO, the other almost certainly would. But ETTV is actually an offshoot of the ExtraTorrent tree of websites, which TorrentFreak predicted would be the No. 3 most popular torrent sites of 2015 (three spots higher than the dearly departed EZTV). A cursory glance through the most popular torrents on the biggest aggregators show that the most recent TV episodes are almost exclusively being distributed by ETTV. YIFY Let's get one thing straight: YIFY is not known for its TV torrents. As EZTV was to television, YIFY is to movies, consistently churning out clear DVD- and BluRay-quality videos in easily downloaded formats. Titles currently trending on YIFY include “Spongebob Squarepants: Out of Water” and the National Geographic movie “Killing Jesus.” But there's also a deep catalog of full TV series available. Looking for free, complete collections of “Curb Your Enthusiasm” or “Weeds”? YIFY's the place. BTN Short for Broadcast The Net, BTN has been the subject of Reddit scuttlebutt for months. But unlike ETTV, YIFY and other public trackers, BTN requires users to get an invitation before they're allowed to access a trove of free TV shows. How do you do that? Good question, but BTN announced in January that it was quickly approaching its user cap, meaning invitations are becoming even more precious. “In recent months, BTN has grown closer to reaching the user limit than ever before. There are no plans to raise the user limit, which unfortunately means that we have to find ways to slow our growth,” the site's administrators wrote in a post reproduced on Reddit. “The number of invites available to each user has been set to zero. This applies to all user classes.” NovaKing's Next Website Finally, no one is quite sure who exactly makes up the group that built EZTV. But the various interviews with anonymous members over the years have given birth to the legend of NovaKing, the supposed leader of the EZTV developers. NovaKing's far from a Dread Pirate Roberts-type character, but he (or they) built an internationally renowned piracy site that existed in a legal black hole, running it for 10 years before walking away. Isn't it possible he would do it again, but make it even better?
  19. Just because you are not a customer of iiNet does not mean you are going to avoid being fined for illegally downloading Dallas Buyers Club. The Australian rights holder to the film plans to target customers of Telstra, TPG, Optus and all other Australian Internet service providers (ISPs), the rights holder's lawyers confirmed to Mashable Australia. BitTorrent Sync update brings usability improvements The recent update to BitTorrent Sync 2.0.120 introduces several usability improvements to the file synchronization and sharing application. The new version introduces a search function, optional columns to display additional information in the program interface and an option to hide offline devices in the My devices list. The update has been released for all supported desktop operating systems and both free and pro licenses. The new search is probably the biggest new feature that the update introduces. It is available at the top and enables you to search folders, users and devices. If you search by user for instance, you get a listing of all folders that the particular user is linked to. As you may have noticed already, file search is not supported which seems strange as you are left with using the operating system for that. It would make sense to include file search directly in the program as well, for instance to quickly launch specific files right form it. Since files are not included, its use increases with the number of folders, users and devices that the software manages for you. If you just use it to sync between two of your devices, it may not be beneficial at all but if you use the Pro version with hundreds of folders, users and dozens of devices, then you will benefit from it as it enables you to quickly jump to specific items. The two new columns owner and last transferred can be added to the interface with a right-click on the header and the selection of the items in the menu. There you find additional items that you can activate, for instance information about data transfers, dates when a folder was added or synced, or the path of it on the local system. The final feature addition enables you to hide offline devices on My Devices which you access with a click on the settings icon in the top right corner of the screen. This can be useful to remove old devices from the list of devices, for instance if you no longer use them. The full changelog lists additional improvements and fixes in this release. For instance, the settings you make in a folder's share dialog are now remembered the next time you open it. New context menu icons have been added to the native file explorers on Windows and Mac systems. A preference to remove these menu items is not provided right now which means that you need to use a program like ShellExView for that or remove the modifications manually. Closing Words The new version introduces features that move BitTorrent Sync closer to existing file sharing synchronization solutions
  20. Dallas Buyers Club LLC (DBC), represented by Marque Lawyers, successfully fought for the right to access personal information of Internet service provider iiNet's customers in a landmark federal court case earlier this year. "DBC will be writing to the other ISPs in the next week seeking consent to similar court orders as those obtained against iiNet," Marque Lawyers partner Nathan Mattock said. DBC is hoping the iiNet case, which saw the ISP pay 75% of the rights holder's court costs, will encourage other ISPs to skip a court battle and instead hand over the details of customers caught illegally downloading the Voltage Pictures film starring Matthew McConaughey. "Given privacy issues, the court will need to make an order, but given the iiNet judgment Mattock said the iiNet case, which captured the IP addresses of more than 4,700 Australians during a one-month period, is only a "test case" that captured the uploads (or seeds) of a small selection of pirates. This capturing method — using German Maverick Eye technology — is expected to be extended to all other Australian ISPs over a 12 to 18-month period. In Federal Court on Thursday, DBC resisted iiNet's request for A$108,000 in security before it hands over customer IP addresses. DBC's lawyer, Barrister Ian Pike, said the rights holder wanted to "have it out" on the amount, with an eye to keeping costs down in future legal action. Justice Nye Perram agreed the decision would set a significant precedent for Australian piracy cases. ISPs want $108,000 in security before handing over customer details. DBC resisting. #iidallas — Ariel Bogle (@arielbogle) May 21, 2015 DBC lawyer says they want to "have it out" about costs, with an eye to precedent. #iidallas — Ariel Bogle (@arielbogle) May 21, 2015 Justice Perram: "whatever happens in this case is going to shape what happens in future cases." #iidallas — Ariel Bogle (@arielbogle) May 21, 2015 When a person downloads a movie using BitTorrent, the film also automatically uploads, making it available to other pirates. The illegal torrenter can be caught red-handed when Dallas Buyers Club is uploaded. "One of the things with the BitTorrent network, there are ample steps [users take] to engage in that network and engage in the file sharing of copyright works," Mattock added. An infringer could be fined the cost of damages for their piracy activities, plus an amount the court decides will serve as a deterrent for others. In Australia, there has been no precedent set for this figure. Fines will be determined on a "case by case" basis, taking into account personal situations, Mattock said. It is very unusual that illegal downloaders have only pirated once, Mattock said. "To say Dallas Buyers Club was the only film you downloaded is highly unlikely, but it may occur," Mattock said. "People on the BitTorrent network, using anecdotal evidence, will engage in the use of that network on a regular basis." He dismissed the A$10 penalty listed in a blog by iiNet as a "myth," stating this is the cost for a download. DBC is seeking damages from those who instead uploaded the film, albeit sometimes automatically without their knowledge. "It may be only $10 for a download, but the damages for an upload and the additional damages are yet to be determined," Mattock said. This means infringers can expect to pay much larger sums, especially if they are a regular user of BitTorrent. Once iiNet provides customers' details, letters will be sent to infringers. DBC will then try to resolve the issue with a pirate through a settlement, or take proceedings against an individual if they deny the claim. The four-page letter — the draft of which will be approved "in papers" by Perram, the judge said on Thursday — will not include a monetary value, but instead outline the infringement and call for the pirate to open up discussions with DBC lawyers, Mattock told Mashable Australia. One of the main requirements included in the April judgement is that the court has to oversee the letter sent from DBC to iiNet customers, to prevent "speculative invoicing" — where large sums are demanded and an infringer is told if they pay they will avoid being taken to court. "The letters are quite thorough, they don’t just make statements, they have the full explanation because one of the things my clients want is to make people fully aware of what has occurred on their network, what is the legal position and what they are proposing," Mattock said. With no value for damages being listed within the letter, the court will not be involved in this process, often leaving infringers to negotiate their own settlements. On Wednesday, iiNet said in a blog post it would offer pro-bono legal assistance to any of its affected customers. Telstra told Mashable Australia it will only provide customer information to a rights holder if a court requires the company to do so. "If a court did order disclosure of customer details, we would want to make sure there are appropriate protections in place for our customers’ privacy and we would work with any impacted customers so they understood what was taking place," Telstra spokesperson Steve Carey said. An Optus spokesperson told Mashable Australia Optus’ terms and conditions do not permit customers to use their services for illegal purposes such as copyright infringement. "Optus considers all requests for access to customer information on their merits and co-operates with law enforcement agencies and courts," she said. At the moment, there may only be thousands of Australian pirates walking the plank, but with DBC setting its sights on making all Australians cut their pirating habits — when it next casts its net, tens of thousands of infringers may be caught. Australia, step away from the BitTorrent. iiNet and TPG did not immediately respond to requests for comment.

  22. Piracy Web Sites Net $209M From Digital Ads Online content pirates make a nice living from digital advertising -- and a lot of this business comes from ads for premium brands that appear on their sites, raising issues about brand safety and reputation, according to a new study conducted by MediaLink on behalf of the Digital Citizens Alliance. Overall, piracy Web sites made $209 million from digital advertising in 2014, unchanged from the previous year -- including ads from 131 recognizable brands, up from 89 in 2013. Over the same period, the proportion of high-traffic piracy Web sites displaying ads from recognizable brands crept up from 28.9% to 32.3%. A previous study by Incopro found that 88% of European pirate sites relied on ad revenue for some or all of their revenues. As with legitimate publishing, pirated video is the new-high growth category for online thieves, with streaming video allowing them to tap video ad dollars. Total revenues for video streaming sites increased 68.2% in 2014 to $46.2 million. Larger illegal video streaming sites saw average revenues from digital advertising soar from $310,769 in 2013 to $846,701 in 2014, while smaller streaming sites took in an average $36,753 from digital ads in 2015, up from $15,573 in 2013. Ads for premium brands appeared on 28.6% of sites with pirated video. Of course, there are continuing efforts by law enforcement, publishers and intellectual property owners to stamp out piracy, but for the most part the pirates just set up shop somewhere else. Almost half the pirated sites identified in 2013 were forced to shut down, but MediaLink still identified 589 sites offering downloads or streaming of pirated content in 2014, virtually unchanged from 596 sites identified in 2013. The DCA noted that the Interactive Advertising Bureau is moving to address the problem, including an audit to determine exactly how much advertising is appearing on pirate sites. At the same time, the report also pointed to new challenges, including the rise of consumer-generated streaming video sites like Meerkat and Periscope, which allowed thousands of users to illegally broadcast the Mayweather-Pacquaio fight earlier this month.
