A QUEENSLAND police officer on trial for raping a woman he had met on a dating website apologised for his alleged actions shortly after, a court has heard.

Kurt Nesterowich is accused of raping the woman twice, choking her and indecently assaulting her during their first meeting a year ago.

Crown prosecutor Matthew Hynes told Brisbane District Court that Mr Nesterowich was drunk when he arrived at the woman’s Brisbane home in April 2016.

They had met via a dating website and during discussions before their meeting, the woman set clear boundaries, Mr Hynes said.

The woman, who can’t be identified, had invited Mr Nesterowich to her home but had told him she was ill and not interested in sex.

“I’m legitimately doped up on cold and flu meds, are you coming over for sleep? or expecting booty because I’m telling you no sex will be had,” she texted.

“If you try and initiate more I’m throwing you out on your arse,” she followed up in another text.

When Mr Nesterowich arrived, the pair went to her bed with an understanding that cuddling and spooning was fine, but nothing more.

Mr Nesterowich, however, attacked the woman twice, choked her three times and indecently assaulted her, the jury heard.

“The defendant didn’t just push some boundaries here, he shattered them,” Mr Hynes said.

“He did that in her own bed, in her own house in the middle of the night against what she wanted.”

After the first alleged attack, Mr Nesterowich stumbled to her bathroom, returned naked and raped her a second time, the court heard.

Shortly after the alleged attacks, the woman kicked Mr Nesterowich out.

He then sent apology texts, the court heard.

“‘Sorry, I genuinely wanted to cuddle,’ he wrote,” Mr Hynes said.

The court heard many facts in the trial weren’t in dispute and questions around consent would be central to the jury’s deliberation.

The trial is expected to run for four days.
