  11. Two individuals accused of millions of dollars worth of Android piracy signed plea agreements with the U.S. Government last week, but at least one other defendant has different things in mind. With the hiring of a "much-feared civil rights lawyer", the former operator of Applanet is going on the offensive against the DOJ. In the summer of 2012, the FBI with assistance from French and Dutch police shut down applanet.net, appbucket.net and snappzmarket.com, three sites that offered Android apps outside Google’s ecosystem. The action was heralded as ground-breaking, with the authorities seizing the domains of these alternative stores and putting up the now-infamous FBI banner to inform visitors of their fate. Together it was claimed the sites were responsible for millions of dollars in losses to software producers. News of the shutdowns came in August 2012, but it took until last week for the U.S. Government to provide a significant update. The Department of Justice revealed that two of the three operators of the Appbucket site had signed a plea deal with the Government and now face sentencing in June. But while the Appbucket guys appear to have accepted their fate, the former admin of Applanet certainly has not. Speaking with TorrentFreak, Attorney Rain Minns says her client is still under fire, but won’t be giving in. “It is extremely unfortunate that some of the young people targeted by the government’s dragnet have been forced to plead guilty,” Minns told TF. “But this is an inevitable, and incredibly sad and disheartening, consequence when the United States unleashes the power and resources of the most powerful nation on earth against defenseless citizens who, like Aaron, care about free and open world-wide access to publicly available information, and who have not earned any significant income for their efforts.” But while Minns says that the mere threat of a long prison term is enough for even the most innocent citizen to plead guilty, that isn’t going to be happening in Aaron’s case. FBI Seizure “Aaron is an extraordinarily brave and ethical young man, who is not willing to buckle under the pressure of the government’s abusive practices. He believes that someone should stand up to abuse of power, and he is willing to put himself at risk if that is the only way to keep information sites free and open.” To that end and in an effort to level the playing field against the Government, Minns informs TF that Aaron’s legal team has just received a significant boost. “After an extensive vetting process, I have now been joined by Attorney Antonio Ponvert III, an accomplished and much-feared civil rights lawyer from Connecticut who, to put it plainly, has enjoyed kicking the government’s ass for almost 25 years,” Minns explains. “Antonio’s task is to take the offense in Aaron’s case, focusing on the government’s violation of state and federal civil rights laws, the First Amendment free speech implications of the government’s tactics, and the substantial reputational and financial harm that the D.O.J. has inflicted, and will continue to inflict on Aaron. One can be sure that a damages case is coming down the pike if, and when, an indictment is forthcoming.” Through his lawyer Aaron informed TF that while it’s a pity that the Appbucket guys were “forced to buckle under the heavy-handed threats of the government”, he wishes them luck as he looks forward to his own day in court. From the tone of the language employed by Rain Minns and by extension Antonio Ponvert, there appears to be plenty of appetite for a fight, should the Government decide to go the whole way against Aaron. If they do, Minns is confident he will prevail. “It is not even close to a fair fight anymore.   14. Since The Humble Bundle launched in 2010 to almost immediate success, the Internet has been absolutely flooded with similar pay-what-you-want bundles of various indie games. Even amid this flood, a new indie game bundle stands out, both for its selection of titles and its distribution method. The Pirate Bay Bundle is a free collection of 101 small indie titles that I can almost guarantee you've never heard of, let alone played. Curator Moshboy describes the collection as an extension of his Underrated Indie Games series of YouTube videos. "Some were made for game jams, others were made just because, some are made by celebrated game makers, many are made by folks that you won’t know," Moshboy explains. "Many are usually only available to play in your browser, but I managed to convince these wonderful folks to provide me with offline versions." As the name implies, this massive collection of games is being distributed via a BitTorrent link on The Pirate Bay, with the cooperation of all the creators involved. While other indie bundles have also shared their DRM-free games via BitTorrent, I'm not aware of any that have willingly offered their selections entirely free via the popular and perpetually legally pressured torrent-sharing site (though that hasn't stopped some people from turning to piracy to save a penny on other bundles). The whole deal reminds us a little bit of the case of McPixel, which creator Sos Sosowski deliberately promoted via a free Pirate Bay download that got some prominent promotion from the Pirate Bay itself. It's certainly a far cry from game developers that use fake torrents of their games as an ironic honeypot for potential pirates. In any case, while we haven't had a chance to dig into all 101 games yet, we've managed to find a few thought-provoking time wasters just poking around the selection for a few minutes (check out Konkey Dong and Get Closer if you need a place to start). Even if none of the titles end up being engrossing epics that take dozens of hours to complete, it's hard to beat the price.

The German entrepreneur Kim Dotcom, who is currently wanted by US for copyright infringement and money laundering in connection with the Megaupload web service, has launched a political party in New Zealand. The Internet Party manifesto said it would fight for net neutrality, faster broadband and online privacy. The party plans to challenge the next parliamentary election in September. Dotcom came to notoriety as the founder of the cloud-based file hosting service; Megaupload, which was forcibly shut down by the New Zealand authorities back in January 2012 on behalf of the US Department of Justice. Dotcom is accused of illegally earning around $175 million through the website, whilst at the same time causing losses of approximately $500 million for the US entertainment industry. The business entrepreneur is still continuing to battle an extradition order, with the next hearing scheduled for June 2014. If he is convicted in the US, he faces a sentence of up to 20 years incarcerated in a state institution. News has emerged this week that one of Dotcom’s recent projects, the successor to Megaupload; Mega, is now valued at around £108 million due to ‘reverse takeover’ agreement. Internet Party The Internet Party has promised to reform copyright legislation, facilitate faster and cheaper Internet connections and boost the economy of New Zealand’s technology sector through benefits and incentives. The party also has plans to bring in a New Zealand-sponsored digital currency along similar to Bitcoin. The Party needed 500 paying members to run for the elections and they achieved this goal in around seven hours, partly due to the website and app that were specially developed for this venture “The Internet Party app is symbolic of everything the Internet Party represents…We’re a breath of fresh air, and a dose of common sense, for a tired and adversarial political system that has lost touch with modern New Zealand and the Internet generation,” Dotcom said. To become a part of the next government, the Internet Party needs to win an electoral seat or secure five percent of the vote.   19. As of now, site scraping will no longer be tolerated. This needlessly burdens our website and offers no benefits at all other than being a few seconds faster in the whoring race. Anyone found doing this will be banned. Just to clarify, as there appears to be some confusion as to what site scraping is. It's the automated extraction of information (usually, new torrents) using methods other than RSS or the API. Pressing F5 does not qualify, not do you have to worry about what your torrent client is doing (unless you are using a scraping plugin for that client). We have perfectly good ways for auto-downloading your movies and weekly shows, such as RSS and the API. Note that even when using the API or RSS there's still no good reason to hammer it. Secondly, we want to remind you that you need permission from the original uploader if you want to upload a HDBits torrent somewhere else. This message is mostly aimed at people more or less auto-uploading HDBits content to other sites. Anyone found doing this will be banned. This includes but is not limited to people running a janhouse script.

  21. The Pirate Bay is known to surprise the world around this time of year, but a new plan announced today goes far beyond what we've seen in the past. The notorious torrent site has partnered with Russian, Israeli and Japanese neuroscientists to launch a new virtual reality initiative, The Virtual Bay. virtual bayThe Pirate Bay has been around for more than a decade and has undergone quite a lot of change during that time. However, nothing comes close to today’s announcement. “We’re about to take the biggest step in our history,” says TPB in a blog post that went out earlier than expected. In addition to changing the look of its frontpage the site has renamed itself to ‘The Virtual Bay’ to celebrate a new partnership with neuroscientists from Russia, Israel and Japan. The goal is to build a next generation virtual reality device that will change the way people interact with the site and the pirated media it offers. “As piracy is about to change from sharing of files into the sharing of everything, we’re planning our departure from this earthly form. Preparing our final ascension into the transcendence. The final conflux,” the TPB team notes. Traditional media companies are resisting change and have been slow to pick up on virtual reality, but The Pirate Bay is jumping in to fill this void. When the site’s device is ready, Pirate Bay users will be able to actively participate in the games and videos downloaded from the site. “Using a simple plugin into the brain, you will no longer only be able to see and hear a movie, a game or whatever it is you want. You’ll be able to live it. Play the main character. Tweak any story in any way you want,” TPB writes. In addition, the virtual reality component will store the entire Pirate Bay ecosystem in people’s minds, making it accessible instantaneously, faster than ever before, and impossible to shut down. In other words, the people will become The Pirate Bay and take the site to a new dimension. “Using your brain power and nervous system, we will be able to speed things up. Every part of The Pirate Bay will be stored within you and everyone else that dares to participate in this step into the future. The more we are, the faster everything will be. “Our scientists calculate that if we become at least 1,333,337 nodes, everything will be shared instantaneously,” the TPB team adds.   22. City of London Police is continuing its crackdown on piracy with the launch of an official blacklist that advertising agencies can use to disrupt cash flow to allegedly infringing sites. The "Infringing Website List" is maintained by the the Police Intellectual Property Crime Unit in collaboration with entertainment industry groups. cityoflondonpoliceOver the past few months City of London Police have been working together with the music and movie industries to tackle sites that provide unauthorized access to copyrighted content. Initially the police only sent warning letters to site owners, asking them to go legit or shut down. Late last year this was followed by a campaign targeted at domain registrars, asking them to suspend the domain names of several so-called pirate sites. Today sees the launch of the next initiative in “Operation Creative,” an official URL blacklist of “pirate sites”. The Police Intellectual Property Crime Unit (PIPCU) just launched their “Infringing Website List” (IWL) and are encouraging advertising agencies to embrace it. The main goal of the blacklist is to disrupt the revenues of infringing websites worldwide. Together with the movie and music industries the police carried out a three-month pilot which resulted in a 12% reduction of ads from major brands appearing on these sites. To what extent the blocklist will hurt total revenues is unclear though, as there are dozens of ad firms who focus on file-sharing sites, and these are unlikely to join the program. The police and their partners, however, are convinced that the blacklist will have a positive effect, not only in terms of cutting off revenue to pirate sites, but also as a tool to prevent advertisers being associated with rogue websites. “If an advert from an established brand appears on an infringing website not only does it lend the site a look of legitimacy, but inadvertently the brand and advertiser are funding online crime,” PIPCU Chief Andy Fyfe says. From the information that was made available to TF, it appears that the blacklist will not be open to the public. This is worrying, since there is a serious threat of overblocking without any public oversight. For example, in their announcement the police cite a recent report on the profitability of pirate sites. However, that report included many sites with perfectly legitimate uses, and even a purely informational website that doesn’t host or link to infringing content at all. Concerns aside, music industry group BPI is confident that the “Infringing Website List” will turn out to be another successful voluntary agreement focused on tackling online piracy. “The early results from Operation Creative show that through working with the police and the online advertising industry, we can begin to disrupt the funding that sustains illegal websites and the advertising that lends them a false air of legitimacy,” BPI’s Chief Executive Geoff Taylor says. Similarly, the Hollywood backed group FACT is also positive about the new initiative. “FACT is delighted to be working with PIPCU to deliver a unique initiative that puts the UK at the forefront of brand protection by allowing everyone in the advertising value chain to prevent misplacement of ads,” Kieron Sharp, Director General at FACT says. “For those rogue sites that continue to provide access to illegally obtained films and TV programmes there will now be affirmative action taken by PIPCU to ask them to change their operation or shut up shop,” he adds. Whether the “Infringing Website List” will indeed have a significant impact on the business of the affected sites has yet to be seen. In any case, City of London Police and the entertainment industries are determined to keep the pressure on. Update: The City of London Police confirmed to to us that the blacklist will not be made public. “All sites on IWL are identified and evidenced as infringing by rights holders and then verified by PIPCU. We are not making the IWL public. For years now, Internet users have gotten used to the risk of having files and content they share through various online services be subject to takedown requests based on the Digital Millennium Copyright Act (DMCA) and/or content-matching algorithms. But users have also gotten used to using services like Dropbox as their own private, cloud-based file storage and sharing systems, facilitating direct person-to-person file transfer without having to worry about such issues. This weekend, though, a small corner of the Internet exploded with concern that Dropbox was going too far, actually scanning users' private and directly peer-shared files for potential copyright issues. What's actually going on is a little more complicated than that, but shows that sharing a file on Dropbox isn't always the same as sharing that file directly from your hard drive over something like e-mail or instant messenger. The whole kerfuffle started yesterday evening, when one Darrell Whitelaw tweeted a picture of an error he received when trying to share a link to a Dropbox file with a friend via IM. The Dropbox web page warned him and his friend that "certain files in this folder can't be shared due to a takedown request in accordance with the DMCA." Whitelaw freely admits that the content he was sharing was a copyrighted video but still expressed surprise that Dropbox was apparently watching what he shared for copyright issues. "I treat [Dropbox] like my hard drive," he tweeted. "This shows it's not private, nor mine, even though I pay for it." In response to follow-up questions from Ars Technica, Whitelaw said the link he sent to his friend via IM was technically a public link, and theoretically could have been shared more widely than the simple IM between friends. That said, he noted that the DMCA notice appeared on the Dropbox web page "immediately" after the link was generated, suggesting that Dropbox was automatically checking shared files somehow to see if they were copyrighted material, rather than waiting for a specific DMCA takedown request. Dropbox did confirm to Ars Technica that it checks publicly shared file links against hashes of other files that have been previously subject to successful DMCA requests. "We sometimes receive DMCA notices to remove links on copyright grounds," the company said in a statement provide to Ars Technica. "When we receive these, we process them according to the law and disable the identified link. We have an automated system that then prevents other users from sharing the identical material using another Dropbox link. This is done by comparing file hashes." Dropbox added that this comparison happens when a public link to your file is created, and that "we don't look at the files in your private folders and are committed to keeping your stuff safe." The company wouldn't comment publicly on whether the same content-matching algorithm was run on files shared directly with other Dropbox users via the service's account-to-account sharing functions, but the wording of the statement suggests that this system only applies to publicly shared links. We should be clear here that Dropbox hasn't removed the file from Whitelaw's account, but just closed off the option for him to share that file with others. Indeed, in a tweeted response to Whitelaw, Dropbox Support said that "content removed under DMCA only affects share-links." Dropbox explains its copyright policy on a Help Center page that lays out the boilerplate that "you do not have the right to share files unless you own the copyright in them or have been given permission by the copyright owner to share them," and directs users to its DMCA policy page. Dropbox has also been making use of file hashing algorithms for a while now as a means of de-duplicating identical files stored across different users' accounts. That means that if I try to upload an identical copy of a 20GB movie file that has already been stored in someone else's Dropbox account, the service will simply give my account access to a version of that same file, rather than forcing me to upload an identical version. This not only saves bandwidth on the user's end, but significant storage space on Dropbox's end as well. Some researchers have warned of security and privacy concerns based on these de-duplication efforts in the past, but the open source Dropship project attempted to bend the feature to users' advantage. By making use of the file hashing system, Dropship effectively tried to trick Dropbox into granting access to files on Dropbox's servers that the user didn't actually have access to. Dropbox has taken pains to stop this kind of "fake" file sharing through its service. In any case, it seems a similar hashing effort is in place to make it easier for Dropbox to proactively check files shared through its servers for similarity to content previously blocked by a DMCA request. In this it's not too different from services like YouTube, which uses a robust ContentID system to automatically identify copyrighted material as soon as it's uploaded. In this, both Dropbox and YouTube are simply responding to the legal environment they find themselves in. The DMCA requires companies running sharing services to take reasonable measures to make sure that re-posting of copyrighted content doesn't occur after a legitimate DMCA notice has been issued. Whitelaw himself doesn't blame the service for taking these proactive steps, in fact. "This isn't a Dropbox problem," he told Ars Technica via tweet. "They're just following the laws laid out for them. Was just surprised to see it." Still, we feel this is important information for Dropbox users to know about the limitations on how they can use their account. Any Dropbox file shared via a "public link," even if it's a link that you only intend to share with a single person, is being compared against a database of previous material subject to the DMCA, and could be blocked on those grounds.

  32. Tech giant Microsoft is blocking access to TorrentFreak on its internal network. According to the notice employees see, our news site is censored because it violates the company's security policy. Another fine example of overblocking. Here at TorrentFreak we frequently cover website blockades against file-sharing websites, which are often put in place on copyright infringement grounds. In many European countries, for example, national courts have ordered ISPs to block access to sites such as The Pirate Bay and Kickass.to. However, that’s not the only type of blocking and filtering that’s common nowadays. There are thousands of companies, schools and other organizations that voluntarily use commercial blocking software to restrict access to objectionable or threatening sites. As with all filters, however, there are false positives. TorrentFreak, for example, is often categorized as a file-sharing site, and blocked to prevent copyright infringement or other associated “threats”. Apparently this is also happening at Microsoft, where the filter managed by the local information security risk management department blocks TorrentFreak on the internal network. Microsoft employees who try to access our site are welcomed with the following message. “The requested resource has been blocked as an identified risk to your client and the Microsoft corporate network.” TorrentFreak Blocked at Microsoft Click here to view the original image of 924x530px. The notice shows that TorrentFreak is blocked under the “peer-to-peer file sharing” category. A false positive, of course, and one that results in a form of overblocking many perfectly secure and legitimate sites are suffering from. Unfortunately the issues above are not limited to Microsoft. Every other week we are notified by readers who can’t access TorrentFreak since it’s blocked at their work or school because the site is classified as a source of illegal file-sharing. More often than not we’re collateral damage. Just a few weeks ago we learned that the UK ISP Sky blocked TorrentFreak for all subscribers who turned on their “porn” filter. After the BBC got involved the block was eventually lifted, but other sites may not be so lucky. If anything, the above shows that these filtering systems can cause harm to legitimate sites, and the people responsible should be called out for it. TorrentFreak reached out to Microsoft to ask for a comment, but thus far without any luck.
