  1. It’s the first official day of spring and you know what that means -- it’s time for CBS to follow in ABC’s footsteps by announcing its end-of-season schedule. Not only will ‘How I Met Your Mother’ end its run with a one-hour series finale, but ‘The Crazy Ones’ has also earned an hour-long Season 1 finale (even though the Robin Williams and Sarah Michelle Gellar comedy has yet to be renewed). Lastly, ‘Survivor’ will finish out its season with a two-hour finale, and, of course, follow with its traditional reunion special. Here’s the CBS 2014 finale schedule: Monday, March 31 8/7c: ‘How I Met Your Mother’ (one-hour series finale) 10/9c: ‘Intelligence’ Monday, April 14 9:30/8:30c: ‘Mom’ Thursday, April 17 9/8c: ‘The Crazy Ones’ (one-hour season finale) Monday, May 5 8/7c: ‘2 Broke Girls’ Wednesday, May 7 10/9c: ‘CSI’ Thursday, May 8 9/8c: ‘Two and a Half Men’ Friday, May 9 9/8c: ‘Hawaii Five-0’ 10/9c: ‘Blue Bloods’ Tuesday, May 13 8/7c: ‘NCIS’ 9/8c: ‘NCIS: Los Angeles’ 10:01/9:01c: ‘Person of Interest’ Wednesday, May 14 9/8c: ‘Criminal Minds’ Thursday, May 15 8/7c: ‘The Big Bang Theory' 8:31/7:31c: ‘The Millers’ 10:01/9:01c: ‘Elementary’ Sunday, May 18 8/7c: ‘The Amazing Race’ 9/8c: ‘The Good Wife’ 10/9c: ‘The Mentalist’ Monday, May 19 9/8c: ‘Mike & Molly’ Wednesday, May 21 8/7c: ‘Survivor’ (two-hour season finale) 10/9c: ‘Survivor Reunion Special’ Don’t forget that CBS also renewed 18 of its shows just last week. You can check those out here.
  2. Kim Dotcom and his alleged Megaupload co-conspirators have been denied access to the evidence gathered by U.S. authorities against them. Megaupload's legal team argued that this information is essential to mount a solid defense, but the Supreme Court ruled that full disclosure is not required under New Zealand law. dotcom-prezSince Megaupload was shut down two years ago, Kim Dotcom and several of his colleagues have been wanted by the United States, each standing accused of copyright infringement related crimes. Despite the severity of the charges, Megaupload’s legal team does not have insight into all of the relevant documents the U.S. Government relied upon to arrive at its conclusions. Through the New Zealand courts Dotcom and his fellow defendants have requested access to this withheld information. To mount a proper defense they want to see the extent to which the U.S. authorities can back up their criminal charges. Initially the District Court granted the request for full access to the U.S. evidence. However, March last year these rulings were overturned by the Court of Appeal, which concluded that the United States could move forward with a summary case. After the defeat Dotcom and his legal team quickly filed an appeal at the Supreme Court, which today ruled against the entrepreneur and his associates. According to the Court’s ruling, the District Court was wrong to order full disclosure of all U.S. evidence. The Supreme Court states that the New Zealand Extradition Act doesn’t require a foreign country to share all evidence with the accused, and the District Court had no statutory power to rule otherwise. After hearing the verdict Dotcom responded on Twitter with a sad face. “Being defeated is often a temporary condition. Giving up is what makes it permanent,” he quoted a few minutes later. :-( — Kim Dotcom (@KimDotcom) March 20, 2014 Earlier this week Dotcom enjoyed success in another legal matter by obtaining a gag order against his former bodyguard Wayne Tempero. After resigning a few months ago, Tempero was supposedly planning to make “secret revelations” about Dotcom’s private life. Under the injunction obtained by Dotcom, Tempero is “restrained from using or disclosing to any person, firm, corporation or entity, any confidential or trade information acquired whilst working for Kim Dotcom.” The former bodyguard is reportedly going to appeal the gag order in the hope of regaining his free speech rights. There is also talk of a possible lawsuit against his former boss. For now, however, Dotcom’s legal team will shift its focus to the upcoming extradition hearing. After yet another delay, the hearing is currently scheduled to take place in July this year.
  3. Copyright is easily infringed by people on a daily basis, such is its complications. However, when you're an anti-piracy group complaining about piracy on The Pirate Bay, it helps if your press release is your own work and not simply ripped from a news site. Add unlicensed images into the mix and things start getting embarrassing. Back in December authorities in South Africa made their first ever arrest of an online movie pirate. The individual, who was connected to a leak of a high-profile local movie on The Pirate Bay, quickly became the focus of the country’s main movie-related anti-piracy group. The Southern African Federation Against Copyright Theft (SAFACT) clearly appreciated the significance of the development, with their CEO Corné Guldenpfennig explaining they had caught the man by employing a hacker. The group further clarified via a piece on their own website. “The senior investigator on the E-Task Team is an internationally accredited CEH, or certified ethical hacker. This team was able to identify, profile, and trace the uploader based on their investigation on the Internet,” SAFACT wrote, adding: “When asked about the significance of the case, Guldenpfennig said that it is a first for South Africa and that they made extremely certain of all the rights issues around this situation.” Unfortunately, making sure “of all the rights issues” wasn’t something carried out by SAFACT in respect of their own website. Let’s take a look at an excerpt from the SAFACT announcement currently displayed on their site, with the focus on the last few lines. SAFACT1 Funnily enough, it turns out that the much of the SAFACT article, minus a few alterations that would identify the source, was lifted from an article written by Jan Vermeulen for MyBroadband.co.nz. SAFACT2 But lifting the text from a news outlet and passing it off as their own work wasn’t the end of the matter for SAFACT. HTXT.africa has noticed some other issues which for a major pro-copyright group should be a major source of embarrassment. The problem relates to the image the anti-piracy outfit published alongside their ‘version’ of the MyBroadband piece. Courtesy of Google cache, here it is: SAFACT3 As can be seen from this Google reverse image search, the center photograph is actually related to the arrest of a LulzSec member carried out by the Australian police and published without the necessary Reuters credit. The fact that the police were Australian was hidden, however, after someone working for SAFACT took the image (from a video shown on The Guardian) and Photoshopped out “Australian Federal” from the officer’s coat leaving just “police” behind. (Original below) SAFACT4 In an email to htxt.co.za, SAFACT CEO Corné Guldenpfennig laid the blame for the image (not the article) at the feet of their web design company. “I wish to confirm that SAFACT would never intentionally infringe on any individual or company’s intellectual property rights as it is the mission of SAFACT to protect and enforce IPR,” Guldenpfennig said. But things really take a turn for the weird when one notes that although SAFACT later removed the unlicensed image and replaced it with the image here, they have since taken that down and replaced it with a new version of the unlicensed Reuters image. Quite bizarrely SAFACT has animated the graphic in a way that only highlights the fact that they ‘shopped the original image. You can see it here, but we’ve included it below for reference. SAFACT Anim Quite possibly the most bizarre response to a copyright issue this year.

  5. Streamza, a handy service that allows people to stream music or video torrents directly from the cloud, is no longer allowed to accept PayPal payments. According to the payment provider Streamza violates its policies, even though it has plenty of legitimate uses. paypaldeniedPayPal is widely known for its aggressive stance towards BitTorrent sites, Usenet providers and file-hosting services, and it appears that streaming services based on BitTorrent technology are receiving the same treatment. Last summer Polish developer and Wikidot CEO Michal Frackowiak launched Streamza, a torrent download service that lets users stream music and movies securely to their PC, TV, iPhone or iPad. Streamza has been growing steadily ever since and welcomes thousands of new users each month. Earlier this week, however, the developer was presented with some bad news. Without prior warning, PayPal stopped providing payment services to Streamza and limited the associated account. That also means that all funds have been frozen for the time being. “They emailed to inform me that my PayPal account had been reviewed and that Streamza does not comply with their policies. My account became ‘limited’ until I removed PayPal from checkout and agreed to their policies, which I did immediately,” Michal informs TF. The PayPal ban is a major setback for Streamza, as it will no longer be able to process new and recurring membership fees from premium subscribers. At the time of writing the PayPal account is still locked, and Michal hasn’t heard from PayPal after the initial email. As usual, PayPal remains vague about the precise reason for the ban. The payment provider mentioned that Streamza violated their Acceptable Use Policy, which suggests that PayPal is concerned about possible infringing uses of Streamza. PayPal’s policies don’t allow “infringing” services to accept payments. In addition, the company requires file-sharing services to be pre-approved. “Service Requiring Pre-Approval: Offering online dating services; providing file sharing services or access to newsgroups; or selling alcoholic beverages,” PayPal’s AUP reads. This approvals process requires services to agree to a list of strict terms and conditions. As can be seen below, this includes full disclosure of the processes that are in place to deter piracy, and allowing PayPal to actively monitor their service for copyright infringements. While Streamza doesn’t promote copyright infringement in any way, it could be used to download or stream pirated files, much like any other streaming or download services including YouTube. Michal believes, however, that the payment provider is more strict with smaller players. “When looking at these policies I wonder how the hell Mega.co.nz can work with PayPal. Somehow I am not that surprised: rules between two bigger players can be different from between a bigger player and a smaller one,” Michal tells TF. Technically, PayPal may have the right to cut off Streamza under its policies, but it would have been appropriate to send an early warning. Over the past few days the service could only accept payments via Bitcoin, which is hurting business. Due to personal circumstances Michal had plans to auction off Streamza, and the PayPal issue is the straw that broke the camel’s back. He is accepting bids on Flippa and hopes someone is willing to take over the service, to keep the 34,000 registered users happy. “I believe that after half a year of running Streamza I created something cool. A project that some people love. It’s not only a great tech and user interface, but a service that fills a niche,” Michal says. “Personally I hope someone smart can take it from here. It’s a really good piece of tech and a project that has its fans.”
  6. The Australian newspapers are outraged after finding out that the tech giant managed to work out a way of avoiding giving billions to its taxman. In the meantime, the company has already been in hot water for overcharging the local citizens for its shiny toys. Now Apple seems to be refusing to pay tax in Australia. Local media pointed out that part of the idea of a trickledown effect is that Apple should pay tax to fund such things as welfare programs, but Apple has worked out a way of avoiding paying most of the tax. The company is said to have shifted almost $9 billion in untaxed profits from its Australian operations to a tax haven structure in Ireland within the last 10 years. For example, back in 2013, the company reported pretax earnings in Australia of only $88 million, but before that Apple sent an estimated $2 billion of income from its Australian sales to Ireland via Singapore, where it negotiated a secret tax deal 5 years ago. The local media got a decade’s financial accounts for Apple Sales International, the secretive Irish company at the heart of Apple’s international tax arrangements. That information revealed the mark-up company charges for intellectual property on its products across the globe. It is known that it was the first time that the financial details of the scale of Apple's tax avoidance has been made public. So, Apple Sales International has reported over $100 billion of profits in the last 5 years, while paying less than 0.05% in tax. Apple’s contempt for paying tax was the focus of a 2013 report by the US Senate's Committee on Homeland Security and Government Affairs, Permanent Subcommittee on Investigations. The report in question also pointed out to the amount of tax avoidance that the American authorities let through. Despite the fact that the tech giant is creating worldwide revenues the size of the California state budget, it is refusing paying tax anywhere. Although the architect of its tax strategy, the chief financial officer, has announced his retirement in the US a few days ago, the company is likely to continue his course, as it is perfectly legal. The matter is that Apple moves all cash to Ireland where it pays no tax because the company is managed and controlled in California. At the same time, Apple pays no US tax either because American legislation disregards where a company is managed and only looks at where it is legally registered. After the Irish government tried to close this "double-non-taxation" loophole, the company simply chose a tax residence with no corporate tax – Singapore, and continues to pay no tax.
  7. Researchers at the University of Stanford claimed they had found a way of improving Wi-Fi reception. One of the problems of Wi-Fi is that it can be buggered up when there are too many people packed into one building, but the researchers seem to have found a way to solve this problem. The researchers claimed they have found a way to turn crowding into an advantage. With a dorm on the Stanford campus, the researchers created a single, dense Wi-Fi infrastructure which each resident could use and manage like his or her own private network. They called the network BeHop, and said it could be be centrally managed for maximum performance and efficiency with users keeping assigning their own SSIDs (service set identifiers), passwords and other settings. According to Yiannis Yiakoumis, a Stanford doctoral student who first presented the research at the Open Networking Summit, the whole network can be managed with cheap consumer-grade access points and software-defined networking. In the meantime, we all know that each household installs its own Wi-Fi network with a wired broadband link out to the Internet. Now it is clear that each of those networks may be powerful enough to allow for good performance under optimal circumstances within the owner’s unit, while it may suffer from interference with all the other privately run networks in the nearby apartment. The researchers built a shared network of access point using home units provided by NetGear. Yiakoumis and his colleagues modified the firmware of those access points, and using SDN, they virtualized the private aspects of the network. In their experiment, residents could name and secure their own virtual networks like they had bought and plugged in a router in their own rooms. Hopefully, their research will help to improve Wi-Fi at everyone’s homes.

  11. RIAA started new efforts to force Google to take more action against pirate sites. RIAA CEO speaks about the problem managing DMCA request. Many sites simply ignore the abuses, some others require too long to answer on takedown notices and some delete infringing links and replace them with new URLs. RIAA, together with music industry, believes that Google and other search engines could do more to stop sending traffic to abuses sites. It seems to be that Google limits the amount of DMCA requests per copyright holder, so many copyright protection companies have to wait till they can submit full lists of links. Google says that they receive takedown notices for far less than 1% of indexed URLs. Google also provide each copyright holder with automated tool where they can submit links and they will be excluded from search automatically what shows high trust fro Google’s side toward copyrighters. This tool causes much problems with DMCA requests because of possibility to abuse URLs that do not contain any infringing content. RIAA CEO explain the problem with some of big sites: after link removal the system automatically re-submit the same file under new URL and it appears in search some days later again. So it seems to be a never-ending story for RIAA to submit the same links day after day. Since many years RIAA and all other copyright holder dream of deindexing of all torrent sites. They try to play a role as Internet police and force Google to censor the network. This strategy seems to be wrong: as much you try to forbidden something, as more popular it gets. The best solution for all content providing services is to make better SEO - to make better sites with good content and get the best rankings in search result index. In this way they would get the majority of traffic to legal content distributing sites. The more the copyright holders try to force someone to play their play, the more people will fight against them. Today, Google is not just a search engine - it’s the main source where we all get our daily information. If we wish to stay up-to-date or download a file, or read news etc. we trust Google because they show us sites where we can get searched content.
  12. Hollywood studio Warner Bros. is fighting a request from the Electronic Frontier Foundation to a Florida federal court to unseal details of the movie studio's anti-piracy practices. The sealed documents are part of Warner's DMCA-abuse case against Hotfile, and the movie studio says that pirates could "infringe without fear of detection" should enforcement tactics be exposed. warnerpirateTo deal with the ongoing threat of online piracy, major Hollywood studios have entire divisions dedicated to tracking down copyright infringers. Exactly what goes on behind the scenes is a mystery, but if the Electronic Frontier Foundation (EFF) has its way, part of this veil will soon be lifted. Last month the digital rights group asked a Florida federal court to unseal the filings Warner submitted in its now-settled DMCA abuse case against Hotfile. EFF argued that the public has the right to know what mistakes Warner made. Knowing how Warner Bros’ anti-piracy system works will be instrumental in discussing the effectiveness of the DMCA takedown procedure and similar measures. This week Warner opposed the EFF’s request. The movie studio fears that by exposing the sealed documents pirates will obtain an unfair advantage. According to David Kaplan, Warner’s Senior Vice President of Anti-Piracy operations, the information “would give pirates multiple routes for evading detection and copyright enforcement.” “Persons familiar with Warner’s methods and strategies for identifying unauthorized Warner content online could infringe without fear of detection if they knew how the detection worked,” Kaplan informed the court. The above is intriguing, as it suggests that there are ways to bypass Warner’s anti-piracy systems. While this may be as simple as using anonymizer tools, the studio clearly doesn’t want the public to know. The opposition filings themselves are heavily redacted, but Warner warns the court that exposing their secrets could allow more “criminals” to avoid justice. From Warner Bros’ redacted filing The movie studio asks the court to keep the documents under seal, and accuses EFF of having a secret agenda. Warner believes that the digital rights group is not so much interested in serving the public good, and suggests that the EFF mostly wants to use the information to their own advantage. “Although EFF claims that this unsealing would serve the ‘public interest,’ EFF’s motion is a thinly-veiled effort to gain access to Warner’s confidential information for EFF’s own tactical advantage in private litigation that EFF regularly brings against copyright owners to challenge their use of takedown systems,” Warner writes. In EFF’s case, the public interest may of course be aligned with the interests of the group itself. However, the Hollywood studios believe that EFF is mainly interested in scandalizing. “Plaintiffs’ concern that EFF’s true intentions are to exploit the sealed information in order to ‘promote scandal’ regarding Warner and other copyright owners is fully justified, and tips the balance even further toward continued sealing of the designated information,” Warner informs the court. According to Warner, the EFF’s reasoning doesn’t trump their right to protect their anti-piracy secrets. This is not to avoid “embarrassment” as EFF suggests, but to prevent pirates from outsmarting them. If the sealed documents were exposed, this could severely damage Warner’s operation, they claim. “As Plaintiffs have explained, this detailed information could be used by infringers to evade Warner’s copyright enforcement efforts. That such disclosure would cause significant harm to Warner’s copyright enforcement efforts is beyond serious dispute,” Warner stresses. It’s now up to the court to decide whose interests weigh stronger. If Judge Kathleen Williams decides to unseal the documents, it will be interesting to see what Warner is so afraid of.
  13. The American government sent a representative to China to negotiate about online security who even had no idea what an ISP was. An ex-head of US homeland security Janet Napolitano also admitted: "Don't laugh, but I just don't use email at all." Media reports explained that it wasn’t because of a fear of privacy or security: it was because she simply didn't think it was useful. Peter Singer, director of the Centre for 21st Century Security & Intelligence, pointed out that a supreme court justice also told him that he hasn't got round to email yet, and this is someone who will get to vote on all issues from net neutrality to the NSA negotiations. Another American official about to negotiate Internet security with China asked him to explain what "ISP" meant. Peter Singer compared it with going to negotiate with the Soviets and not knowing what 'ICBM' means. In addition, he admitted to have similar experiences with officials from the United Kingdom, China and Abu Dhabi. Media report remind readers about the G20 conference, where diplomats were spearfished by an email “linking” to nude photos of former French first lady Carla Bruni-Sarkozy. Many of them followed the link to download spyware onto their machines. Singer adds that many online security threats and solutions are misrepresented or overblown. He said that power lines were taken down far more often by squirrels, but yet so far no squirrel had been taken out by a drone, or put on a no fly list. He believes that the US government response is often too reactionary – like the treatment of pirates and privateers in the age of sail, while investment in a public cyber health campaign could appear much more efficient.
  14. Google is currently facing a penalty of up to $5 billion if the tech giant is found to have violated antitrust laws in India. The company has been facing a full investigation in the country by the fair trade watchdog, the Competition Commission of India (CCI), for the last couple years. The American antitrust watchdog came to a conclusion that Google’s services were good for competition, but in the US multinational corporations can generally do what they like. The antitrust case has been before the CCI as well for more than 2 years now and it relates to allegations that the search engine is abusing its dominant position in the online search engine space. According to Google spokesperson, the outfit was extending full co-operation to the CCI in their investigation. It is known that the tech giant has settled antitrust cases in the United States and European Union, but unfortunately the Indian competition regime doesn’t have provisions for settlement processes. In addition, a complaint filed with CCI can’t be withdrawn. Finding prima facie evidence of violations, the commission had referred the matter to its investigation arm for a detailed probe. Local media also revealed that the DG has also collected comments from 3rd parties with regard to this antitrust case and is likely to submit its report to the commission in the nearest future. Aside from penalty, the authority also have right to pass orders to correct a company's conduct in the market place. The CCI can go for structural remedies which could see breaking up of dominant enterprises into separate businesses. First Google complaint was filed by advocacy group CUTS International two years ago. Then, matrimonial website matrimony.com filed another complaint.
  15. Former NSA contractor tried proper channels to raise concerns about government surveillance programs before turning into a whistleblower. Edward wrote to the European Parliament that he reported policy or legal issues related to snooping programs to at least ten officials, but since he was a contractor, he had no legal avenue to do anything. All of those officials ignored him. Edward Snowden confirmed he had reported spying programs to more than ten distinct officials, but none of them took any action to address his concerns. The Snowden’s problem was that he wasn’t protected by American whistleblower laws, and wouldn’t have been protected from retaliation and legal sanction for revealing classified data either. Last summer, President Obama said that there were "other avenues" available to a whistleblower like Snowden, whose “conscience was stirred” and who believed he needed to question government actions. Nevertheless, the president seems to be unaware that the laws didn’t apply to contractors, only government employees. Instead Edward was just warned not to rock the boat, threatened with the sort of retaliation former NSA whistleblowers like Wiebe, Binney, and Drake faced. All of them were subject to intense scrutiny and the threat of criminal prosecution. Some believe this issue should be someone else's problem – even the highest-ranking officials Snowden told about his concerns failed to recall when an official complaint resulted in the shutdown of an unlawful program, only saying that “there clearly was a unanimous desire to avoid being associated with such a complaint in any form”. In response, the National Security Agency disputed his account, claiming that after extensive investigation, including interviews with Snowden's former NSA supervisors and co-workers, they didn’t find any evidence to support his claims that he tried to bring these matters to anyone's attention.

  23. Last year Finland wrote history after it became the first country to vote on a "fairer" copyright law, crowd-sourced by the public. Now that the vote is near, several lawmakers have warned against the disastrous effects of the proposal, by parroting a memo handed to them by the copyright lobby. finlandThe Finnish constitution allows citizens to draft and submit legislative proposals for Parliament to vote on. All proposals that get 50,000 supporters within six months will be referred. This also happened to a crowdsourced draft for a “fairer” copyright law which reached the required threshold last summer. Termed “The Common Sense in Copyright Act,” the proposal aims to reduce penalties for copyright infringement, increase fair use, ban unfair clauses in recording contracts, and ease the ability for people to make copies of items they already own for backup and time-shifting purposes. Last month the proposal was first presented in the Finnish Parliament. This piqued the interest of copyright lobby groups, who handed over a memo to Members of Parliament before the hearing, to inform them on their stance. Needless to say, the entertainment and media companies were rather critical of the public proposal. What was more surprising though, is that many MPs repeated the rhetoric that was put forward in the pamphlet. Member of Parliament Kauko Tuuppainen went as far as parroting from the memo word-for-word, which was noticed by fellow MP Oras Tynkkynen, and later picked up by the Finnish press. Below is a translation of Tuuppainen’s address in Parliament: “The proposal could make Finland into a safe harbor for international piracy. Why? Because it encourages copyright infringement in many ways. One would be free to copy illegal content from the internet according to the proposal.” – MP Kauko Tuupainen in the initial hearing in Parliament. Now compare this to the language used by the copyright groups in their memo: “The proposal would make Finland into a safe harbor for international piracy. The proposal encourages copyright infringement in many ways. One would be free to copy illegal content from the internet according to the proposal.” – Joint announcement by the content and media industry organizations. The two descriptions of the law are nearly identical, with several phrases being read word-for-word directly from the memo. Open Ministry, the organization that coordinates the public law proposals, is not happy with the display of lobbyists’ influence. The whole idea of the public proposals is to hear the voice of the public and experts, but some MPs would rather parrot lobbyists’ opinions. “Since copyright issues can be complex, we asked MPs to first hear what the experts have to say on the suggested changes, before shooting them down based on industry lobbyists objections and exaggerated propaganda. They did not,” Open Ministry Chairman Joonas Pekkanen says. “The suggested changes are not that radical, since there is national room to maneuver within the boundaries set by the EU Copyright legislation,” he adds. The above shows that the copyright lobby has a strong influence on lawmaking, and that in some cases the voice of the public can be easily countered by a handful of lobbyists. While it doesn’t leak out in public very often, it’s not a big secret that industry groups have a strong say in the laws that are enacted worldwide. Just a few months ago it was revealed that 150 amendments to the EU data protection bill, submitted by Belgian Member of European Parliament Louis Michel, were copy-pasted from lobbyist paperwork. For the Finnish “fairer” copyright law there is still hope though. The proposal has now been referred to the Culture Committee, who will advise on whether to accept it later this year.
