  1. The staff is pleased to announce two updates to our upload rules regarding FLAC and AAC. This is part of a wider effort to make small and manageable changes to our uploading rules instead of waiting for huge overhauls that can be very difficult to implement and digest. Rule 2.1.1 has been updated to read We understand there will likely be a healthy debate regarding the decision to cap FLAC at 24/192. This rule change is not to say anything positive or negative about the various arguments for and against 24-bit, 192 kHz audio, but rather to draw a line in the sand and say something much clearer: we do not find a purpose to What.CD offering content above a depth of 24 bit and 192kHz sampling rate. Additionally, we have clarified our policies on AAC torrents and how they may or may not be trumped.   3. I really hate having to do this, it's something as a site owner I never wanted to have to do, but it seems that each and every month now we are struggling more and more to pay the bills. Without donations this site will simply cease to exist. I cannot put it any clearer than that. Our goal here was to create a site that was ratio free with blistering pre times but done on a shoe string budget. We don't ask for thousands like other sites do and yet we offer just as fast pre times (Faster in MOST cases). We do not offer Pay2Leech facilities like many others, we are ratio free anyway ? And yet we struggle to scrape together 500 Euro each month in order to pay the bills ? Is there a reason for this ? Something we are doing wrong ? Something we can fix maybe ? Change ? If you don't feel we are worth it then that is fine, we can accept that, but at least let us know
  4. The Vault values the immense contribution of all members. Naturally, we are often asked "how does a member become a VIP+?" The answer is that VIP+ members are chosen purely on their history of valuable and consistent interaction with the membership. Being a VIP+ is a privilege. Too many times, that valuable and consistent contribution that led to VIP+ status, disappears after promotion. Whilst we, of course, are thankful for the many contributions that VIP+ members have made, we also believe that continued interaction is a minimum expectation to maintain that preferred status (even if that interaction is less intense). Fair warning: we will be revisiting the status of all those members that have VIP+ status. When and how The Vault deals with the issue are yet to be decided.

Okay, with all that said we are in desperite need of donations to keep the site up and running. Piracy ‘Whistleblower’ to Remain Anonymous, Court Rules A person who claimed that the operators of Grooveshark were engaged in systematic copyright infringement will keep his anonymity, a court has ruled. The allegations, which were made in the comments section of an online news article, prompted Grooveshark's parent company to unmask their author. They have now failed in that mission. In 2010, Universal Music Group (UMG) sued Grooveshark owners Escape Media in the Supreme Court of the State of New York, claiming that the company infringed their copyrights by storing and subsequently distributing tracks to which UMG holds the copyrights. In 2011, news site Digital Music News (DMN) published an article which contained claims from a member of a rock band that Grooveshark had illegally hosted the band’s music and refused to take it down when notified. The article attracted around 100 comments from DMN readers, one of whom claimed to be an employee of Escape Media. The commenter, who posted under the name “Visitor”, claimed that he had regularly received “direct orders from the top” at Escape to upload music to Grooveshark’s servers. Worse still, “Visitor” claimed that the company would not fully remove infringing content, even if artists or music labels complained. These allegations were viewed as problematic by Escape since in order for a service provider to gain immunity under the Digital Millennium Copyright Act (DMCA), it must remove copyrighted material once it becomes aware that an infringement has taken place. So, in an effort to unmask this supposed employee of theirs, in January 2012 Escape served a subpoena on Digital Music News in order to obtain “Visitor’s” identity. After DMN refused to comply, in March 2012 Escape petitioned the Los Angeles Superior Court for enforcement. DMN was subsequently ordered to comply but promptly filed an appeal. DMN argued that unmasking “Visitor” would not lead to the discovery of evidence admissible in UMG’s New York lawsuit against Escape (identifying information about “Visitor” had all been deleted) and that enforcement of the subpoena would infringe on the First Amendment rights of both DMN and “Visitor”. Ultimately the court decided that since Escape had presented a prima facie case that “Visitor’s” comments were libelous, no First Amendment protection was available. DMN was ordered to comply with the subpoena and provide a copy of its server to Escape. DMN copied the servers but lodged an appeal in attempt to avoid handing them over. This week the Court of Appeal of the State of California handed down its decision and it’s bad news for Escape. Escape had argued that proving “Visitor’s” comments to be false would help them show that the company did not supervise direct infringement of UMG’s copyrights. The Court rejected Escape’s basis for needing access to “Visitor’s” identity stating that this “out-of-court quarrel is of no consequence to the determination of UMG’s lawsuit.” Escape enjoyed no success on the privacy front either. “Even if Visitor’s identifying information was reasonably calculated to lead to admissible evidence, his or her right to privacy under the California Constitution would outweigh Escape’s need for the information,” the Court said. “That interest begins with Visitor’s need for a venue from which to be heard without fear of interference or suppression. Visitor’s anonymity also frees him or her from fear of retaliation, an even more compelling interest if Visitor truly is an Escape employee, as represented, because exposure could endanger not only his or her privacy but also livelihood.” The Court concluded with a summary of its opinion as to the value of “Visitor’s” comments. “Visitor has done nothing more than provide commentary about an ongoing public dispute in a forum that could hardly be more obscure — the busy online comments section of a digital trade newspaper,” the Court wrote. “Such commentary has become ubiquitous on the Internet and is widely perceived to carry no indicium of reliability and little weight. We will not lightly lend the subpoena power of the courts to prove, in essence, that Someone Is Wrong On The Internet.” With that the Court of Appeal ordered the trial court to vacate its order enforcing the subpoena and thereby protecting “Visitor’s” privacy.
  17. Student Wins Pirate Bay Domain To Protest Website Blockades A student has been awarded a valuable Pirate Bay-related domain after successfully complaining to Denmark's domain name dispute body. ThePirateBay.dk will now be taken away from its current owner and transformed into a special site to protest the ISP blockade of The Pirate Bay in Denmark. The Pirate Bay is one of the most popular sites on the Internet and has inspired the creation of many copycat sites, many of which play on Pirate Bay’s imagery, branding, name, or a combination of all three. While some sites make it obvious that they’re paying homage to the infamous torrent site, others have malicious or financial motives in mind. As a result there are plenty of domains out there looking to capitalize on users’ naivety or simple inability to spell. Ironically, while many official Pirate Bay domains are blocked in countries around Europe, these unofficial and often fake variants are allowed to continue business as usual. Occasionally, however, the authorities step in. One such instance involves ThePirateBay.dk, a domain whose most recent registration occurred in August 2010. The domain was owned by a James McAvoy of Bristol, UK, who appears to be a prolific purchaser of domains, as illustrated below. Over in Denmark, where The Pirate Bay has been blocked since 2008, a Danish student had been eyeing the domain. He felt he had a good chance of wrestling it from McAvoy’s control due to the Brit’s failure to adhere to Denmark’s domain name rules. In his complaint the student told the Complaints Board for Domain Names that he doubted that the contact listed in the WHOIS was a “genuine or real registrant” and criticized the same person’s registration of many “typosquatter” domains (such as youtupe.dk) which are deliberately linked to “advertising traps”. With Denmark’s Domain Names Act noting that “a domain name which typosquats another domain name may be suspended and subsequently blocked or deleted”, the student’s complaint appeared valid. Next, the student complained that ThePirateBay.dk had been put up for sale. The Domain Names Act expressly forbids a registrant to “reserve, register and maintain registrations of domain names solely for the purpose of selling or renting to other parties.” In contrast to the owner of ThePirateBay.dk who had no valid use for the domain, the student presented an argument to the domains board that he did. “I want to use thepiratebay.dk to protest against Danish web censorship in the form of the blockade of the address thepiratebay.org imposed on the Danish internet providers,” the student wrote. “I want to create a support page for The Pirate Bay where I criticize the decision and show my support for the blocked page. I am a student, not a trader, and I act as an individual in what I would call a protest against the imposed blockade.” The complaints board weighed the arguments and in a decision published a few days ago, agreed with the student’s position and upheld his complaint. “The Board finds that there is hereby created a strong presumption that the purpose of the defendant’s registration of the domain name ‘thepiratebay.dk’ [..] was to gain financially by its reassignment. The Respondent, who has not replied to the Complaints Board’s [attempts at contact] , did not contradict that presumption.” All things considered it was concluded that James McAvoy’s registration of the domain should be canceled and ThePirateBay.dk should be transfered to the the student by June 13, 2014. Exactly what form the student’s protest will take using his newly obtained domain remains unknown, but it’s nevertheless interesting that the right to protest against a website blockade of the world’s most infamous torrent site trumps making ad money from a similar looking domain.
  18. Hosting Provider Plagued by DDoS Attacks on Torrent Sites Several torrent sites hosted at Genious Communications have been suffering from DDoS attacks of up to 30 gigabits per second. Thus far the identity of those behind the attacks remains a mystery, but the CEO of the hosting service isn't ruling out the involvement copyright watchdogs. BitTorrent trackers are no strangers to Distributed Denial of Service (DDoS) attacks. Pretty much all sites of a respectable size are targeted on occasion by unknown sources. In most cases these attacks don’t last too long, but every now and then they get more serious. For example, in recent weeks several French torrent sites have had to deal with a serious flood of unwanted connections, rendering the sites and trackers in question unavailable. The Morocco-based provider Genious Communications hosts several of the affected torrent sites, including smartorrent.com and cpasbien.pe. To find out more TorrentFreak contacted CEO Hamza Aboulfeth, who told us that the attacks come in all shapes and sizes. “The biggest attack was on smartorrent.com where we had over 30 Gbit/s which gave us no choice but nullroute the IP at the moment of the attack,” Aboulfeth says. The attacks range from common HTTP floods to UDP and SYN flood attacks and huge botnets. As a result, Genious has migrated several clients over to a specialized DDoS protection setup. “We have our own professional DDoS protection system so we had to move some of our clients to it, the rest just moved to Cloudflare where they offer decent protection for a reasonable price,” Aboulfeth says. The biggest challenge is to mitigate the attacks on trackers as these are not dealing with regular HTTP requests, but so far the company has managed to take the edge off the assaults. The attacks started a few weeks ago and have been continuing ever since at varying intensities. They are all targeted at several of Genious Communications’ file-sharing related clients, but the identities of the individuals behind them remains a mystery. Aboulfeth hasn’t heard of any cash demands, which excludes the extortion scheme several other sites were subjected to earlier this year. According to the CEO, it’s most likely that competitors or an anti-piracy group are behind the attacks. “I think the attacks are most likely coming from competitors or some copyright agency,” Aboulfeth says. “One common thing is they are all French torrent websites, and I know for a fact that I have been contacted by someone hosted somewhere else claiming that one of our clients is attacking him, and of course my client is denying that,” he adds. In the long term the sites have no other option than to make sure that they can cope with the DDoS attacks. In most cases they eventually pass, without their victims ever knowing what their purpose was.
