UPDATE (Thursday afternoon) — The Free Speech Coalition today called new “pandering” legislation “reprehensible” and urged members and supporters to voice their opposition to California Senate Bill 1204. SACRAMENTO — A California bill that aims to broaden the definition of “pandering” is wending its way through the Legislature. Introduced in February, California Senate Bill 1204 will be weighed before the state Senate Committee on Public Safety in its first public discussion on Tuesday, April 17, at the state Capitol in Sacramento. The measure will be one of 16 bills discussed at the hearing. Introduced by state Sen. Patricia Bates, it is unknown as to exactly why the lawmaker introduced the bill. An office aide to Bates declined to discuss aspects of the bill with XBIZ. What is for sure, however, is that the bill makes huge changes that could potentially ensnare more criminal defendants when it comes to sex work. SB 1204 specifically amends California’s statute on pandering by seeking to cast a wider net, making it easier to charge individuals who act as third parties. New language in the pandering bill says, “A person who arranges, causes, encourages, induces, persuades, or procures another person to be a prostitute, with the intent that the other person engage in an act of prostitution, is guilty of pandering, a felony ….” Through SB 1204, Bates’ bill would make it a felony to provide any help or outreach to sex workers, including harm-reduction services like distributing condoms or providing bad-date lists. Industry attorney Gill Sperlein told XBIZ that the sex worker industry has seen “an alarming rise” of legislation like SB 1204. “Though proponents claim to target human trafficking, its clear that the real target is all sex work,” Sperlein said. “The legislation stems from a paternalistic notion that men and women cannot make adult decisions for themselves. “Just as the move to decriminalize cannabis and reform all drug laws suggested that the country was moving in the direction of more personal autonomy, we see this kind of backward thinking regressive legislation. LOS ANGELES — The Free Speech Coalition today called new “pandering” legislation “reprehensible” and urged members and supporters to voice their opposition to California Senate Bill 1204. If passed, SB 1204, reported on XBIZ.com today, would make sex work more dangerous, expose sex workers and their advocates to “near limitless legal harassment and prosecution,” the FSC said. The FSC said the following: California Senate Bill 1204 is a bill so regressive and misguided that it could only have been written over the objections of sex workers themselves. SB 1204 would expand California’s prosecution of "pandering" to include any person who “arranges, causes, encourages, induces, persuades, or procures another person to be a prostitute.” This change would make sex work more dangerous, exposing sex workers and sex worker advocates to near limitless legal harassment and prosecution. The new law is written so broadly and poorly that it would criminalize conversations about sex work, sex worker political advocacy, harm reduction efforts, health care interventions, and self-protection by sex workers within the industry — each punishable by a mandatory three-to-six years in prison. Providing condoms to sex workers? Three years in prison Making sure a worker gets home safe? Three years in prison Passing out pamphlets about sex worker resources? Three years in prison We’re not being hyperbolic. Even a cursory review of recent sex worker prosecutions shows that any possible legal angle to harass, prosecute, or intimidate sex workers will be used to its fullest extent by prosecutors, with disproportionate effect on trans sex workers and sex workers of color. Sex workers, particularly those who work in public, can be prosecuted on the mildest pretext, such as possession of a condom. This not only forces them into the shadows, where greater abuse can occur, it forces the abandonment of health and safety precautions. Nationally, sex workers face the most hostile legal environment decades. Last month, new federal legislation (SESTA/FOSTA) resulted in the widespread closure of online spaces for sex workers, from advertising sites where violent clients could be screened in relative safety, to discussion forums used by sex workers to share resources and communicate about potential danger. We have seen a rise recently in legislation which professes to protect sex workers, while actually making it many times more dangerous. SB 1204 is no different. It would remove important protections for sex workers, and force consensual sex workers into increasingly more exploitative situations. For those who work in the industry, SB 1204 is a dangerous and deadly bill. Free Speech Coalition supports the full decriminalization of sex work, but you need not agree with us to find this bill reprehensible. In the Rolling Stone piece, Lansky goes on to discuss that he was exposed to an environment, back in the day, where there was very little competition and piracy in the porn world. “It was insane,” he said. “They were printing money." But Lansky said the "golden age of adult entertainment," as he described it, was short lived, and that many studios were going for the cheap as tube sites got off the ground. Lansky, as an entrepreneur starting up his own adult studio, decided to go the opposing way with his business plan. "I'm coming in and I'm like, 'I want to do the opposite. I want to create a quality that's so superior, and attend to all these little details for customers," he told Rolling Stone. “Lansky's business plan relied on the premise that customers were still willing to pay for quality content through subscriptions, rather than pirate the cheap stuff for free,” Rolling Stone wrote. Investors brushed it off as overly idealistic, if not laughable.
