  3. The U.S. Department of Justice has released a new 191-page filing in which Megaupload is portrayed as a massive piracy hub. The Government is using data obtained from Megaupload’s seized databases to back up and expand several of the allegations against Kim Dotcom and his co-defendants. Among other things, the evidence suggests that “repeat infringers” drove a lot of traffic to Mega’s sites. The document further shows that roughly 43% of all files streamed on Megavideo received a takedown notice.

    megauploadThe Department of Justice recently requested a secret order to help copyright holders by releasing sealed evidence from Megaupload’s servers. Despite protests from Megaupload, the U.S. has now made this information public.

    The evidence offers new details obtained from Megaupload’s databases to back up claims that were made in the original indictment. According to the United States the new evidence makes it even more clear that Megaupload was mostly a piracy hub, and that Kim Dotcom and his colleagues were well aware of that.

    In large part the new evidence deals with how Megaupload and Megavideo responded to DMCA notices. The Government accuses Megaupload of misleading copyright holders, as they only disabled URLs to infringing files, and not the files themselves. In addition, the new evidence shows that “repeat infringers” were allowed to continue uploading copyrighted material.

    For example, the Megavideo database revealed that there were 33 active user accounts that had more than 10,000 URL links disabled through DMCA notices. The decision not to terminate these users was due to the millions of views these repeat infringers were driving, the Government says.

    “In total, links created and distributed by these repeat infringer accounts attracted more than 475 million views on Megavideo.com. Had the Mega Conspiracy terminated the accounts of these repeat infringers, for which they had actual knowledge, the Mega Sites would have lost these millions of views,” the Government writes.

    According to the new information the infringing users were responsible for uploading the files that generated the majority of all views on Megaupload.

    In total there were 93,878 users that had at least one of their links disabled through a takedown notice. The links of these infringing users were accessed more than 27.2 billion times, which is roughly 77% of Megavideo’s total views.

    In addition, the Government claims that 43% of all video files that were viewed on Megavideo had received at least one takedown notice.

    The Government further states that Megaupload was not primarily a cyberlocker, as most users couldn’t store files permanently. Only premium subscribers could store files permanently, and free and unregistered users would lose access to files that weren’t downloaded regularly.

    “One of the databases shows that on or about January 19, 2012, the Mega Sites had approximately 66.6 million total registered users. Of these, approximately 800,000, or roughly 1.2%, were premium subscribers. Therefore, approximately 98.8% of users did not have significant capabilities to store private content long-term,” the Government writes.

    Most users were indeed not interested in storing files, as information from Megaupload’s databases shows that the vast majority of Megaupload’s users never uploaded a single file.

    “In addition, of the 66.6 million total registered users, at most, only 5.86 million registered users, or less than 9%, had ever uploaded a file to either Megaupload.com or Megavideo.com. Therefore, the vast majority of users accessed the Mega Sites to view and download content.”

    The Government then goes on to detail several of the “repeat infringer” accounts, and how the Megaupload team interacted with these users. The evidence also includes various email and Skype conversations between Dotcom and his team where there are seemingly aware of the infringing use of Megaupload.

    The Government had requested to release this information so copyright holders could use it to their advantage in possible lawsuits. Whether the evidence released thus far will be good enough to make a case against the Megaupload team remains to be seen.

  4. Earlier this week a torrent site user was hit with a damages claim of $652,000 for uploading one movie to the Internet. With the huge amount undoubtedly still ringing in the 28-year-old’s ears, questions are now being raised about how this figure was arrived at. It’s an amazing process that shows that sometimes copyright holders may as well just think of a number, double it, multiply it by the day of the week and then add it all to their dog’s age.

    calcThis week was one to forget for an individual dubbed by copyright holders as Sweden’s “worst ever” Internet pirate. The man was a former moderator and uploader at the now-defunct Swebits site and had been tracked down and prosecuted for his sins.

    After concluding in the Västmanlands District Court last month, a few days ago the Court handed down its decision.

    The 28-year-old was ordered to pay $652,000 in damages for the unauthorized distribution of just one of the movies in the case. For the other 517 the man was said to have shared he was handed a suspended jail sentence and ordered to complete 160 hours of community service.

    There can be no doubt that $652,000 is a shocking amount of money, so just how was that figure arrived at? ComputerSweden news editor Marcus Jerrang asked the same question and has come up with a surprising sequence of events.

    Jerrang discovered the amount was based on the expert opinion of a consultant called Bertil Sandgren who specializes in licensing matters.

    “The written statement Sandgren has given the court is a fantastic display of assumptions and causal relations that aren’t backed by evidence,” Jerrang explains.
    How many pirates?

    Sandgren began by listing the number of people who attended Beck movies in the 2000s. The movie in this case, Buried Alive, had the lowest number of visitors at just over 100,000. This, compared to the 320,000 who watched the 2001 movie “The Price of Revenge.” Sandgren decided that 30,000 more people would have watched Buried Alive if it were not for illegal file-sharing.

    The consultant then took a look at how movies were being presented to the public in 2010 and noted a move to digital presentations, with many individual theaters closing down but more multiplexes being built.

    “From experience, a shift of this magnitude should imply a positive visitor development over the next 2-3 years after 2010 by about 20-25 percent,” Sandgren said.

    “The primary reason behind the loss of the increase is most likely illegal downloading,” Sandgren explained, without backing the statement up.
    Licensing and damages

    Moving on, Sandgren looked at how much it would cost to purchase a hypothetical license fee to distribute the movie for free.

    Noting that one million Swedes downloaded movies in 2010, he estimated that 25% of those would have bought movies if file-sharing didn’t exist. From this Sandgren concluded that more than one million would choose to download movies for free if they could do so legally.

    This would result in a 100% loss of revenue for Buried Alive in the video market, so Sandgren decided that any license would need to be based on that total loss. Since Buried Alive pulled in around $865,000 overall, Sandgren put the license price at $835,000.

    Arriving at damages, Sandgren looked at how many people had allegedly downloaded another Beck film in 2007 (said to be 45% of the total viewers) and noted that of those around 25% would have paid for it if file-sharing did not exist. After juggling a few stats an amount of $175,000 was arrived at.
    Other loss of revenue, TV fees and damage to goodwill

    Going on to calculate additional losses, Sandgren noted that “generally speaking, a film of this nature ought to reach an audience that, carefully calculated, is 30 percent larger. That is approximately 130,000 tickets with an improved revenue of an additional [$152,000].”

    Moving on to pay and free TV, an amount of just over $106,000 was added but there are still more issues to be factored in. Sandgren calculated that the free availability of the movie on file-sharing sites would mean more effort would have to be put into selling it – $76,000 more to be precise.

    Furthermore, the movie’s reputation would also be damaged due to the relative low quality of video rips being made available online. That, plus another $7,500 in punitive damages, added another $53,000 to the total.

    Jerrang says that the District Court believed almost everything that Sandgren presented, since he was deemed to be credible after presenting evidence in the Swedish case against The Pirate Bay.

    In the end, however, the court opted to compensate for just 50% of the market, ultimately arriving at the headline $652,000. Incredibly, no complaint was filed by the file-sharers’ lawyer meaning that this “think of a number” game will almost certainly be repeated again in future.

  5. A recent study has revealed that removing DRM from album would boost revenue rather than losing it to pirates. It turned out that music revenue rise 10% on general content and 30% on other content.

    It means that the customers don’t like when the rights owners place restrictions on content and prefer to buy something else instead. Digital rights management has been a complete disaster, because pirates found it easy to bypass, but the system had a nasty habit of bricking machines it couldn’t cope with. As a result, people using pirated versions were getting better quality because the DRM wasn’t making their lives a misery and actually discouraged them to buy legitimate product.

    The research was based on a survey of over 5,800 albums from 634 artists and compared the sales figures before and after the labels decided to drop DRM. It works if the entertainment industry tries to bring in DRM-like controls using such things as album release dates, music genre and regular sales variations over time.

    For example, older albums selling less than 25,000 copies saw their sales grow by 41% and overall lower-selling albums got a 30% sales increase. So, DRM only seemed to work for top selling work.

    The researchers point out that the 30% sales increase for lower-selling albums can be due to DRM-free music making it easier for customers to share files and discover new music. Indeed, the finding that removing DRM from top-selling works has almost no effect or negative effect on sales really makes sense, because the discovery element is less important for well-promoted artists.

  6. A federal judge has recently ruled that the NSA’s phone record surveillance program was likely to be breaching the Constitution. Well, everyone knew that, but now it was said aloud, in the court and by the judge. He said that the NSA’s controversial program violates the Constitution’s Fourth Amendment protecting citizens against unauthorized searches and seizures.

    The program developed by National Security Agency collects records of the time and phone numbers of every phone call in the United States, and it allows that database to be queried for connections to suspected terrorists. Media reports say that the judge “couldn’t imagine a more indiscriminate and arbitrary invasion than this regular and high-tech collection and retention of personal information on every citizen for purposes of querying it and analyzing without judicial approval”.

    The judge is sure that the author of the constitution, James Madison, the person who was anti-democracy and believed legislators should be “disinterested” and act against the wishes of constituents, would be aghast by these authorities’ antics. This court ruling came down after conservative activist Larry Klayman filed a lawsuit against PRISM this past summer. The lawsuit claimed that the surveillance program violated the Constitution of the United States, along with federal laws, including the clear breach of privacy, freedom of speech, freedom of association, and the due process rights of US people.

    So, the judge ordered the US government to stop collecting the phone records of the plaintiff and to destroy the records the agency already collected. However, he also stayed that order, thus allowing the government to argue that PRISM doesn’t violate the Constitution.

  7. UK Prime Minster has started censoring the worldwide web for the entire country, and now millions of BT customers are Internet censored from all those things that David Cameron doesn’t like. The Internet service provider confirmed that the filter is on and working.

    New BT customers will have to choose on whether they want to activate the parental controls. They will also have to explain to BT why they refuse and in this case there’s a chance that their IP address will be flagged to be closely watched by GCHQ. As for existing BT customers, those will be contacted by the company during the next year and asked if they want to activate the controls and allow the government to decide what they can access.

    Customers who want to turn the parental controls on will choose between 3 set filter levels – strict, moderate and light. All of them ban porn, obscene and tasteless material, along with hate and self-harm, drugs, alcohol and tobacco and dating websites. In addition, moderate and strict filters will also block websites featuring nudity, weapons and violence, as well as gambling and social networking. Strict filter also blocks fashion and beauty websites, file-sharing, games and media streaming.

    You can always add or remove other websites from the list manually. Moreover, the filter can be turned off at specific times, for instance if you want it to act as a “watershed”, and it can also be set to another level during “homework time”, when kids are busy with their homework. According to BT representatives, the company takes the question of online kids protection very seriously and is glad to launch the whole home filter to help parents keep their families safe on the Internet.

    In the meantime, a recent report by Ofcom showed that less than 50% of parents with children aged 5 to 15 have any filters in place on the family computer, with 13% admitting they either don’t know how to install controls or had no idea it was possible. Perhaps, David Cameron knows better how to look after children, as he famously abandoned his kid in a pub when he went out to dinner with his missus. Some people wish there was a way of outsourcing that responsibility too. Maybe Prime Minister simply doesn’t want to put taxpayer money into a public education system.

    The site isn't without it's issues, we are finding a lot of little 'bugs' and 'kinks' that we didn't see earlier. We are working to resolve all of these issues and hope to be back to 100% shortly.

    •A few issues are, Browse Page isn't updating correctly with latest releases.
    •LiMEY in IRC is on crutches and moving slow.
    •Application system is being hammered throwing up time-outs.
    •Invite Keys may not work upon application acceptance.
    •Tracker isn't acting normal, so you might see seeds one minute and the next, they'll be gone, this is probably due to the fact that it's missed you guys so much.


    Finally, @the7egend and @AtheistP3ace are pretty busy squishing the bugs, so please try not to PM them with anything. If you see something, post it in this thread and we'll get on it as soon as possible.

    He Came In Like A Wrecking Ball


    As I am sure most of you know, we had a pretty major hardware failure roughly 2 weeks ago. It was pretty catastrophic and we've lost over a years worth of data since most of our backups were corrupted when the drives failed. Most of us (staff) hadn't really paid much attention to the fact that our backups weren't being deposited elsewhere. So when we found out the site had fatally crashed, and we went to grab a backup of our database, we were very much gutted to find the last useful one was back in August of 2012.

    We were able to recover bits and pieces of the previous (current) database, however, it was corrupted so it couldn't be imported. We could manually enter all that data back in, but there are 100s of thousands lines of information, imagine what a 1GB text file would look like.

    So here we are, flashing back an entire year.


    WAT DO?

    Good news is, we are dedicated to the site, we spent tireless hours doing what we do best, breaking things and fixing them. So, we've made a lot of changes while we've been down, most of which you might not be able to see, we've increased the speed of the site, added a few new site features on how our data is handled, re-wrote a backup script, and have built the back end of the site unlike any other tracker out there.


    Old Users, New Users, Lost Users

    We lost a few users, some users who were banned and old are probably now active, some users will be completely new here. So to the banned users, you've got a second chance, unless we go through our ragged, corrupted db and find you, to those of you lost, we got you boo, I'm sure if you are reading this, you've already re-applied and we've welcomed you back with open arms. New users, good thing you missed all this mess.

    To all users: We apologize profusely but there is no way to recover your old stats. Your userclass may be set back, and you almost certainly lost BP...but there's simply no way for us to recover all of that data so please don't flood us with requests that say you lost a million BP or a userclass. Our biggest priority right now is recovering old users and torrents!


    Help us Obi-Wan, you're our only hope!

    Erm yes...we need donations right now like we've never needed them before--we had to buy yet another server out of our own pockets. OTOH, if you donated just before #TheGreatCalamity (aka you donated "sometime in December" ) and you're upset about the current conditions, you can request a refund of your donation by sending a StaffPM.

    We also need to recover more than a year's worth of torrents. There are thousands of them so for the first time ever, we'll likely allow users to upload content--but only specific users will be given permission to upload, and only to upload old PixelHD content (no scene crap or other p2p groups, or your uploading rights will be revoked!). If you already have dozens, hundreds of thousands of torrents seeding then you can certainly help us! There will be a forum post later to gather volunteers and tell you what the requirements are.

    Metal.Iplay or RMT (Romanian Metal Torrents) has to be one of the best rock and metal trackers out there. Although it is of Romanian origin, the userbase of the tracker remains large and from all over the world. The site is also mainly written in English and has a generous bonus points system in place where upload credits or invites can be obtained from collected bonus points (up to 10Gb upload!). You can obtain points simply by seeding torrents. The more you seed and the faster you seed it, will result in the bonus points adding up more quickly. Whether it's new or old rock/metal albums, discographies, packs, underground bands, limited releases, obscure artists or the audiophile section devoted to lossless music - if rock and metal music is your thing, then this is the tracker to join. The forums are also very active with a great community and torrent requests are being filled all the time. The speed of the torrents is also surprisingly fast and it is worth noting that contributing to the site (whether uploading or otherwise) can also be used to quickly gain a decent amount of bonus points. The FAQ is in romanian and english too for a better understanding of the rules of the tracker.
