  3. Consumer interest group Digital Citizens Alliance has published a new report highlighting the connection between pirate sites and malware delivery. The group says that as many as one in three pirate sites are engaged in the practice, assisted by US-based companies including Cloudflare. For the past several years, one of the key educational strategies of entertainment industry companies has been to cast doubt on the credibility of so-called ‘pirate’ sites. Previously there have been efforts to suggest that site operators make huge profits at the expense of artists who get nothing, but there are other recurring themes, mostly centered around fear. One of the most prominent is that pirate sites are dangerous places to visit, with users finding themselves infected with viruses and malware while being subjected to phishing attacks. This increasingly well-worn approach has just been revisited by consumer interest group Digital Citizens Alliance (DCA). In a new report titled ‘Enabling Malware’, the Hollywood-affiliated group calls out United States-based companies for helping pirate site operators “bait consumers and steal their personal information.” “When you think of Internet crime, you probably imagine shadowy individuals operating in Eastern Europe, China or Russia who come up with devious plans to steal your identity, trick you into turning over financial information or peddling counterfeits or stolen content. And you would be right,” DCA begin. “But while many online criminals are based overseas, and often beyond the reach of U.S. prosecutors, they are aided by North American technology companies that ensure that overseas operators’ lifeline to the public – their websites – are available.” DCA has examined the malware issue on pirate sites on previous occasions but this time around their attention turns to local service providers, including hosting platform Hawk Host and CDN company Cloudflare who (in)directly provide services to pirate sites. “Are these companies doing anything illegal? No more than the landlord of an apartment isn’t doing anything illegal by renting to a drug dealer who has sellers showing up day and night,” DCA writes. “But just like that landlord, more often than not these companies either look the other way or just don’t want to know.” Faced with an investigative dead-end when it comes to tracing the operators of pirate sites, DCA criticizes Cloudflare for providing a service which effectively shields the true location of such platforms. “In order to utilize CloudFlare’s CDN, DNS, and other protection services customers have to run all of their website traffic through the CloudFlare network. The end result of doing so is masked hosting information,” DCA reports. “Instead of the actual hosting provider, IP address, domain name server, etc., a Whois search provides the information for CloudFlare’s network.” To illustrate its point, DCA points to a pirate domain which presents itself as the famous Putlocker site but is actually a third-party clone operating from the dubious URL, Putlockerr.ac. “From websites such as putlockerr.ac consumers are tricked into downloading malware. For example, when a consumer clicks to watch a movie, they are sent to a new screen in which they are told their video player is out of date and they must update it. The update, Digital Citizens’ researchers found, is the malware delivery mechanism.” There’s little doubt that some of these low-level sites are in the malware game so DCA’s research is almost certainly sound. However, just like their colleagues at the MPAA and RIAA who regularly shift responsibility to Google, DCA lays the blame on Cloudflare, a more easily pinpointed target than a pirate site operator. Unsurprisingly, Cloudflare isn’t particularly interested in getting involved in the online content-policing business. “CloudFlare’s service protects and accelerates websites and applications. Because CloudFlare is not a host, we cannot control or remove customer content from the Internet,” the company said in a response to the report. In common with Google, Cloudflare also says it makes efforts to stop the spread of malware but due to the nature of its business it is unable to physically remove content from the Internet. “CloudFlare leaves the removal of online content to law enforcement agencies and complies with any legal requests made by the authorities,” the company notes. “If we believe that one of our customers’ websites is distributing malware, CloudFlare will post an interstitial page that warns site visitors and asks them if they would like to proceed despite the warning. This practice follows established industry norms.” Finally, while DCA says it has the safety of Internet users at heart, its malware report misses a great opportunity. After years of staying ahead of the authorities, it seems the 30-year-old operator of Kickass Torrents, Artem Vaulin, made some sloppy mistakes to allow police to get their hands on him, including using Facebook and Apple e-mail. In what diehard netizens all over the internet are calling a monumental screw-up, Vaulin was operating a Facebook fan page for his site.It was either vanity of promotional marketing but either way, it proved to be the origin of his demise. When the US government went to Facebook with a warrant for the information related to the fan page, Zuckerberg was only too happy to comply. The data showed the person was using a me.com e-mail address which is owned by Apple. The feds then went to Apple. In another fatal mistake, Vaulin used the me.com e-mail address to — somewhat ironically — make a purchase in the Apple iTunes store. The iTunes store collects users IP addresses when they make a purchase and investigators were able to use that information to link Vaulin’s IP address to his Bitcoin account and it was all downhill from there. Artem Vaulin was arrested Wednesday in Poland and the United States is currently seeking his extradition. KAT started in 2008 and operated in some 30 languages, attracting more than 50 million unique viewers a month and generating up to $US22 million in advertising revenue each year, according to the criminal complaint levelled against Vaulin. The website’s value is estimated at more than $US54 million ($A72m), with annual advertising revenue in the range of $US12.5 million to $US22.3 million, according to authorities.Recently, the site allowed users to download illegal copies of recent hit movies such as Captain America: Civil War, Now You See Me 2, and Finding Dory. Site operators have played cat-and-mouse games with authorities, the complaint alleges, including moving its domain following legal action in several countries like Great Britain, Ireland, Italy, Denmark, and Malaysia.In addition to the charges, a Chicago federal court also ordered the seizure of seven domain names linked to KAT but policing illegal sites is a never ending and virtually impossible task for authorities. Already a separate torrent website isohunt is reportedly hosting a KAT mirror site with illegal torrents. Vaulin, who purportedly used the handle “tirm” online, faces one count of conspiracy to commit money laundering, one of conspiracy to commit criminal copyright infringement and two of criminal copyright infringement. The money laundering count alone carries a maximum 20-year prison sentence. “Copyright infringement exacts a large toll, a very human one, on the artists and businesses whose livelihood hinges on their creative inventions,” US Attorney Zachary Fardon said in the statement. “Vaulin allegedly used the internet to cause enormous harm to those artists.”

  6. NBC UNIVERSAL, the multinational media firm owned by the even bigger conglomerate Comcast, has been granted a patent for technology designed to track torrent pirates. Media companies have tried for years to prevent people sharing video and audio files over the web without paying for the privilege, and the Early detection of high volume peer-to-peer swarms patent aims to put an end to all that. The patent is for software designed to track the sharing of pirated files by large groups of people using popular networks such as BitTorrent. The patent abstract describes it as: "Early detection of high volume swarms in a peer-to-peer network, including a data feed of peer-to-peer swarm activity, and an analytics engine processing the data feed and identifying the high volume swarms that have parameters that exceed a threshold. "The early detection provides for enhanced anti-piracy efforts, improved allocation of network resources, and better business decision-making." In other words, once a certain number of people share a particular file an alarm will be raised and action taken. Torrent news site TorrentFreak noted that NBCUniversal could license the technology to stop the spread of large-scale pirating before these swarms become too big to control. However, TorrentFreak also said that the media firm is likely to tread carefully in any such action since parent company Comcast was widely criticised after an attempt to throttle the bandwidth available to BitTorrent a few years ago. The patent application, which was approved only last week, was submitted eight years ago, since when file sharing has moved on considerably with the advent of streaming by the likes of Netflix and Spotify. Nevertheless, file sharing grew 44 per cent between 2008 and 2014 in the US and even more in Europe, according to Digital Music News, meaning that piracy via torrent sites is far from being yesterday's problem for the industry.

A Ukrainian alleged to be the ringleader of the world’s biggest online piracy site, Kickass Torrents, has been accused of distributing more than $1bn worth of illegally copied films, music and other content. The US justice department unveiled a criminal complaint against Artem Vaulin, 30, of Kharkiv, Ukraine, who was arrested in Poland on Wednesday and is being sought by US authorities for copyright infringement, money laundering and other charges. Vaulin is alleged to own Kickass Torrents or KAT, which in recent years has eclipsed Pirate Bay and others to become the world’s biggest source of pirated media.The criminal complaint said the website offers “a sophisticated and user-friendly environment in which its users are able to search for and locate content” which is protected by copyright. KAT, which distributes films, video games, television programs, music and other electronic media, is estimated to be the 69th most frequently visited website on the internet, according to a justice department statement. “Vaulin is charged with running today’s most visited illegal file-sharing website, responsible for unlawfully distributing well over $1bn of copyrighted materials,” said assistant attorney general Leslie Caldwell. “In an effort to evade law enforcement, Vaulin allegedly relied on servers located in countries around the world and moved his domains due to repeated seizures and civil lawsuits. His arrest in Poland, however, demonstrates again that cybercriminals can run, but they cannot hide from justice.” US officials will seek to extradite Vaulin to face charges filed in federal court in Chicago, which ordered the seizure of one bank account and seven domain names associated with the file-sharing website. The complaint said officials were able to track and identify Vaulin from records provided by Apple on his iCloud account. According to the complaint, KAT operates in 28 languages and has made available movies that were still in cinemas along with other content, earning revenue from advertising throughout its site. The website’s value is estimated at more than $54m, with annual advertising revenue in the range of $12.5m to $22.3m, according to the complaint.KAT has moved its domains several times after being blocked in Britain, Ireland, Italy, Denmark, Belgium and Malaysia, according to the complaint, and has relied on a network of computer servers located around the world, including in Chicago. The move comes with US officials in a long battle to extradite the head of Megaupload, another major piracy site shuttered by the FBI in 2012.The head of Megaupload, known by the pseudonym Kim Dotcom, is free on bail in New Zealand pending the extradition effort, and recently vowed to revive his operations. His extradition appeal is set to begin in Auckland on 29 August and is expected to last four to eight weeks.

  9. Polish authorities arrested Artem Vaulin, 30, of Kharkiv, Ukraine, on charges of operating the world's largest torrent portal, Kickass Torrents (KAT). Known as "trim," Vaulin is KAT's founder and main administrator. According to a criminal complaint filed today, Vaulin faces one count of conspiracy to commit criminal copyright infringement, one count of conspiracy to commit money laundering, and two counts of criminal copyright infringement. Authorities said that KAT had caused damages to copyright holders of over $1 billion and that they plan to request Vaulin's extradition. "KAT is currently down" In addition to Vaulin's arrest, authorities also seized bank accounts in Estonia and Latvia, servers located in Chicago, USA, and Canada, along with some of KAT's domains (kickasstorrents.com, kastatic.com, thekat.tv, kat.cr, kickass.cr, kickass.to, kat.ph). Historically, the torrent portal had only operated via URLS such as kickasstorrents.com, kat.ph, kickass.to, kickass.so and kat.cr. At the time of writing the main domain, kat.cr, was down. The Dark Web version of the site was still up and running. In the past years, KAT had been blocked in countries such as the United Kingdom, Ireland, Italy, Denmark, Belgium, and Malaysia. "Officials used Apple email inbox to track Vaulin's actions" The criminal complaint also reveals that federal agents had gone undercover to gather information about KAT's mode of operation. Agents bought ads on the site to collect data about financial transactions and the site's staff. These actions had revealed Vaulin's email address, [email protected], hosted by Apple. Investigators petitioned Apple for help, who provided a copy of his email inbox to authorities. Using the Mutual Legal Assistance Treaty, US officials were also able to collect information about the site's operations from the bank accounts used to collect payments for ad slots. An analysis of this account later revealed the presence of KAT's servers in Chicago, right in the US' backyard. "Vaulin ran KAT via a front company called Cryptoneat" Authorities also said that Vaulin allegedly operated the KAT portal using a Ukrainian-based front company called Cryptoneat. At the time of Vaulin's arrest, KAT was the 69th most trafficked site on the Internet, a position that not even the infamous The Pirate Bay has ever reached. The site's estimated traffic was of around 50 million unique users per month.

Chicago: The owner of file-sharing website KAT was indicted in the United States on Wednesday for copyright infringement related to the distribution of more than $US1 billion ($1.34 billion) worth of movies, video games, music recordings and other content, US justice officials said. Artem Vaulin, 30, of Ukraine, was arrested in Poland and US officials want him extradited to face charges that include conspiracy to commit criminal copyright infringement and conspiracy to commit money laundering, according to attorneys for the US District Court for the Northern District of Illinois. US officials alleged that KAT, which operates in about 28 languages, has a net worth of more than $US54 million ($72 million) and illegally made available for download movies that were still in theatres such as Independence Day: Resurgence and Finding Dory, the complaint stated. The indictment stated that for financial gain the peer-to-peer file-sharing website, also known as Kickass Torrents, distributed since 2008 copyrighted works such as this year's film Captain America: Civil War. Justice officials and artists' groups have gone after other websites that provided venues for file sharing, such as Napster and Megaupload. The founder of Megaupload, known as Kim Dotcom, is fighting extradition to the United States and has denied allegations that his site has cost film and record companies more than $US500 million ($669 million) in revenue. "Vaulin allegedly used the Internet to cause enormous harm to those artists," Fardon said, adding that KAT relied on computer servers around the world due to efforts to halt illegal file sharing. There was no legal representation listed for Vaulin in any court docket, a US Department of Justice spokesman said. The company could not be reached through websites, which were experiencing outages, and there was no immediate response to a request sent to KAT through social media. One of the domains operated by KAT, Kat.cr, was the 70th most popular website in the world, according to monitoring firm Alexa.
  11. Federal authorities announced on Wednesday the arrest of the alleged mastermind of KickassTorrents (KAT), the world’s largest BitTorrent distribution site. As of this writing, the site is still up. Prosecutors have formally charged Artem Vaulin, 30, of Ukraine, with one count of conspiracy to commit criminal copyright infringement, one count of conspiracy to commit money laundering, and two counts of criminal copyright infringement. Like The Pirate Bay, KAT does not host individual infringing files but rather provides links to .torrent and .magnet files so that users can download unauthorized copies of TV shows, movies, and more from various BitTorrent users. According to a Department of Justice press release sent to Ars, Vaulin was arrested on Wednesday in Poland. The DOJ will shortly seek his extradition to the United States. “Vaulin is charged with running today’s most visited illegal file-sharing website, responsible for unlawfully distributing well over $1 billion of copyrighted materials,” Assistant Attorney General Caldwell said in the statement. “In an effort to evade law enforcement, Vaulin allegedly relied on servers located in countries around the world and moved his domains due to repeated seizures and civil lawsuits. His arrest in Poland, however, demonstrates again that cybercriminals can run, but they cannot hide from justice.” DMCA ignored all day long According to the 50-page affidavit authored by Jared Der-Yeghiayan, Vaulin and KAT claimed that they respected the Digital Millennium Copyright Act, but they did not. Der-Yeghiayan is a special agent with Homeland Securities Investigations and also was a key witness in the trial of Silk Road founder Ross Ulbricht. When Hollywood and other film studios filed a notice-and-takedown for a potential DMCA violation, KAT would respond this way: Greetings, Your request has been reviewed, but cannot be processed due to one (or more) of the following reasons: 1) The Claim wasn't written in English language; 2) You provided no evidence showing that you are the copyright holder or that you are acting on behalf of the copyright holder; 3) You provided no evidence showing that the content is legally copyrighted; 4) There were more then [sic] 30 torrents mentioned in the Claim email; 5) Your content is hosted on a different website. In the complaint, the HSI agent also describes how an undercover IRS agent purchased an ad on KAT in March 2016 at the rate of $300 per day. The KAT representative, "Mr. White," provided details for a Latvian bank but warned the American buyer to "make sure that you don’t mention KAT anywhere." After a successful five-day ad buy, the undercover IRS agent again tried to buy another ad. Mr. White told him that the existing "faster download" ads were all sold out but that he could buy a pricier banner ad at $1,000 to $3,200 per day. By May, Mr. White informed the undercover agent of new banking details, this time in Estonia. Through the Mutual Legal Assistance Treaty (MLAT) process, US investigators were able to easily obtain those bank records. HSI and IRS looked into the historical hosting records of KAT and found that for about 3.5 years, ending in January 2016, the operation was hosted out of Chicago, Illinois, which explains why the case is now being prosecuted out of the Northern District of Illinois. The site also used a Canadian hosting service—the two American agencies also used MLAT to get an image of the Canadian server. Finally, Der-Yeghiayan also described how Apple provided a copy of Vaulin's e-mail account ([email protected]), which included other incriminating information that establishes probable cause of a criminal conspiracy. He concluded by noting that the Costa Rican and Filipino authorities have been alerted and that HSI and IRS would be using the MLAT process to try to seize the kat.cr and kat.ph domains, among others.

The high court of Paris has ruled that Google and Microsoft do not have to censor their search engines to remove all results involving the world "torrent" used in conjunction with the names of three French musicians. The French music producers' association "Syndicat national de l’édition phonographique" (SNEP) had sought a court order to force the US companies to remove results for searches pairing the word "torrent" with the artists' names, which they claimed directed users to pirate sites. As an article on the French site NextInpact explains, the Tribunal de grande instance de Paris refused to grant SNEP's request for Google's search results to be censored because of a legal technicality raised by Google's lawyers. SNEP's request referred to only three artists, and should have been on behalf of its entire membership, the high court ruled. In the case of SNEP's attempt to censor Bing, Microsoft adopted a different defence. The Parisian court agreed with the US company's lawyers that for it to be granted, SNEP's request "must involve specific and identifiable content." In addition, measures needed to be "proportionate and specific for each site listed," and they must be "accurate and necessary, efficient and useful." In the court's view, these requirements were not met, and the request was therefore refused. However, as NextInpact notes, the court went considerably further in its ruling on the Microsoft case. It criticised SNEP's attempt to turn the word "torrent" into some kind of badge of dishonour for search results, and noted how legal sites would be adversely affected too: SNEP's requests are general because they do not concern a specific site, but all sites accessed by the methods cited, without considering the identification or even determination of the site's content, based on the premise that the term "Torrent" is necessarily associated with infringing content, while it is primarily a common noun, which has a meaning in French and English, but also means a neutral communication protocol developed by the company Bittorrent, which provides access to files that can be downloaded lawfully, or corresponds to the names of artists or groups, or is included in site names. The high court went on to say that "the measures sought are similar to general surveillance measure and could cause the blocking of legitimate sites." As well as rejecting SNEP's requests, the Tribunal de grande instance de Paris ordered the organisation to pay €10,000 to both Google and Microsoft to cover their costs. Ars has asked SNEP, Google, and Microsoft for their comments on the outcome, but has not yet received replies. This post will be updated with any responses that are received.
