The Recording Industry Association of America runs into some pushback after objecting to a tool that creates permanent copies of YouTube content. That YouTube is a great place to access free content is known by most. But is the extremely popular video-sharing website also the place to go to download? Thatâs a question provoking controversy and could set the stage for the industryâs next big copyright fight. The subject of the developing battle is youtube-dl, a third-party software tool that enables its users to rip videos and songs from the Google-owned platform. Illegal? Not necessarily, say proponents of the tool. Section 1201 of the Digital Millennium Copyright Act prohibits circumvention of technological measures designed to protect access to copyrighted works. But if there's no circumvention, then there's no Section 1201 violation. And some are questioning whether YouTube has really presented roadblocks. Youtube-dl is âa lot like the videocassette recorders of decades past: a flexible tool for saving personal copies of video thatâs already accessible to the public,â wrote Elliot Harmon and Mitch Stoltz of the nonprofit digital rights group Electronic Frontier Foundation in a November post. EFF is now representing Github, a community of software developers. Upon a takedown notice by the Recording Industry Association of America, Github removed source code for youtube-dl, but then on Nov. 16, Github turned heads by restoring youtube-dl after EFF gave its opinion about the technology at hand. Whatâs more, Github made its stand by establishing a $1 million developer defense fund. The developing fight has the potential to be a consequential one both for the entertainment industry and beyond. Section 1201 has been around for a quarter-century and has been explored a few times in court â most notably when the movie industry fought to ensure that no one cracked encryption and made permanent computer copies of DVDs and Blu-Rays. That said, copyright experts say that what constitutes an illegal âcircumventionâ is largely untested in American courts. What's more, with auto owners, smart phone owners and others now complaining that copyright law prevents them from tinkering, Congress has taken a renewed interest in 1201. Recently, Sen. Thom Tillis (R-NC) has highlighted the need for reform, commenting, "Iâm looking forward to our Section 1201 hearing this month because my sense is that we may need to tweak that provision to ensure that the exemptions adequately account for consumer concerns, including by allowing for third-party repair of software-enabled devices." As for the Section 1201 debate around youtube-dl, the conversation confronts so-called "stream-ripping," a phenomenon that some in the industry worry will erode revenue. Given that streaming platforms have largely supplanted file-sharing hubs this century, it makes sense that access control has become a focal point. Taking steps like a crack down on password sharing is one part of the picture. The industry is also waging a quiet legal war against illegal streaming boxes, pirate IPTV and, now, rippers. However, this latest debate is somewhat unusual as it involves some analysis of the underpinnings of a mainstream site like YouTube. And Google, which owns YouTube, is being very careful about speaking out on the subject, for it has the potential of disrupting its relationships in the content and technology space. As EFF explains it, YouTube employs a âcompletely visibleâ mechanism in order to deliver video streaming to someoneâs web browser. âTo borrow an analogy from literature, travelers come upon a door that has writing in a foreign language,â explain EFFâs lawyers. âWhen translated, the writing says, â[S]ay âfriendâ and enter.â The travelers say âfriendâ and the door opens. As with the writing on that door, YouTube presents instructions on accessing video streams to everyone who comes asking for it.â The RIAA has a completely different take on the technology at hand. As the RIAA sees it, YouTube's coding is akin to the encryption on DVDs preventing anyone from storing a movie on their computer hard drive. âEFF is misguided,â says Ken Doroshow, RIAAâs chief legal officer. âYoutube-dl and other programs that are designed to circumvent YouTube's rolling cipher clearly violate Section 1201. Several courts in the EU have already ruled that the rolling cipher is an effective technological measure that controls access to copyrighted works. We are confident that U.S. courts would arrive at the same conclusion.â YouTube may present a particularly low barrier to anyone who wishes to grab downloadable content, but as obvious as its coding may be, copyright holders say YouTube's content system still represents something that must be deciphered in order to download. To borrow the EFF analogy, nobodyâs saying âfriendâ to open YouTube's door unless thereâs a translator in tow to interpret the foreign language. Thus far, two European courts have sided with the RIAA. The first in 2017 was a regional judge in Hamburg, Germany, who analyzed a service that ripped MP3s from YouTube. The judge granted the recording industry groupâs requested injunction. The second decision came in Denmark last March and may be most notable for including a declaration from a lawyer working inside Googleâs German office. Although YouTube hasnât publicly commented on the recent controversy surrounding youtube-dl, this Google attorney told the Danish court, âIn order to prevent unauthorized downloads on a technical level, YouTube implements so-called âcipherâ technology to mitigate unauthorized access to YouTube content.â (Also, Google isnât above sending its own 1201 notices. Last month, for example, Google complained to Github about tools being used to get around Widevine, its digital rights management technology being used by Disney+, Netflix, Amazon Prime Video and others in distributing videos.) Still, EFF expresses hope that the conclusion of an American court would be different. In its letter advising Github, Stoltz writes, âThe 2017 decision of the Hamburg Regional Court in Germany that RIAA references ⌠was wrongly decided and is not binding nor even persuasive under U.S. law. The court in that case apparently reasoned that since the judge was not familiar with JavaScript, using the âsignatureâ code was beyond the capabilities of the average user ⌠The courtâs analysis overlooks the ubiquity of JavaScript, which is embedded in every browser ⌠making use of the âsignatureâ mechanism well within the capabilities of the average user.â Although Section 1201 of the DMCA has been around for almost a quarter-century, stream-ripping has only recently instigated lawsuits and the "average user" theory hasn't been tested. (That said, thereâs already an RIAA case concerning 1201 before the Supreme Court at the moment on the issue of jurisdiction.) Thus far, no defendant has mounted the type of truly vigorous pushback being teased by Github and EFF. That said, 1201 is a broadly written statute, and according to Sy Damle â a Latham & Watkins partner who formerly was general counsel for the U.S. Copyright Office â the statute âdoesnât require the protection measure to be particularly sophisticated.â Aaron Moss, a partner at Greenberg Glusker, agrees, although he notes that past courts have previously ruled that if one uses a publicly available password, one isnât circumventing access control measures. Like other interested observers, Moss sees the rise of streaming platforms and those looking to rip a little extra access, and says, â1201, being more amorphous and less litigated that traditional takedown notices, is likely to become a new frontier in the cat and mouse game.â

Close to 12 million French internet users consumed pirated content last year, representing a loss of earnings of âŹ1.03 billion to rights holders, according to figures released by the Haute autoritĂŠ pour la diffusion des oeuvres et la protection des droits sur internet (Hadopi), the body set up over a decade ago to combat piracy. According to the Hadopi, âŹ310 million was lost to physical media sales while pay TV services lost to the tune of âŹ260 million. The cost to the public purse in the form of lost tax revenues and charges was âŹ332 million. The Hadopiâs study, the first to attempt to calculate the economic consequences of content piracy and illicit retransmission of sports events in the round, comes as proposals for a new audiovisual law designed to tackle the problem are being discussed. The Hadopi found that while peer-to-peer piracy â the original focus of the Hadopi when it was set up â had declined significantly, illegal streaming and direct download of content had risen and new forms of illegal consumption such as illicit IPTV and live streaming services had also blossomed. While the number of internet users engaged in piracy has barely changed over the last decade, the proportion has declined as more people have come online. Some 80% of those consuming illicit content view movies illegally, with 73% viewing TV series and 50% consuming live sports. Denis Rapone, president of the Hadopi, called for detailed examine of the provisions of the countryâs audiovisual law designed to combat piracy and said that âthe situation is critical but solutions exist. We are absolutely ready to put them to work in the service of improved public policy for the protection of content creation.â Aurore BergĂŠ, a deputy for the ruling LREM party, has proposed new legislative measures to tackle piracy with the support of culture minister Roselyne Bachelot, but this has so far struggled to secure parliamentary time in the face of the public health crisis.

Latvian State Police have detained three individuals suspected of illegally distributing pay-TV signals in the capital Riga and environs. In a statement, they say that in the course of their investigation âinjured partiesâ to these activities, or more specifically âat least two representatives of television programs or subjects of related rightsâ, suffered losses amounting to at least âŹ19,680. They add that the individuals face the prospect of up to four years in prison, temporary custodial sentence, forced labour or a fine.

The Association for the Protection of Copyright on the Internet (AZAPI) has filed complaints with Russia's Federal Antimonopoly Service against Internet giants Yandex and Mail.ru. According to AZAPI, granting some rightsholders access to tools that remove links to pirated copies from search results while denying the same to publishers amounts to an abuse of their dominant market positions. Every week, millions of Internet users turn to search engines hoping to find links to pirated content. Not to so long ago, this could prove effective but in recent years things have changed. Massive delisting operations to remove billions of links using copyright law have been supported by voluntary initiatives by Google, for example, to downgrade sites for which lots of DMCA complaints are received. As a result, basic searches tend to yield often disappointing results, albeit with some exceptions. Delistings in Russia As Part of a Voluntary Agreement In 2018, leading content companies and distributors plus Yandex, Rambler Group, Mail.Ru Group, vKontakte, and RuTube signed up to a landmark anti-piracy memorandum. Supported by the creation of a centralized database of allegedly-infringing content, Internet platforms agreed to voluntarily query the resource in close to real-time to identify and then delete âpirateâ links from their search indexes. Although the Russians have a different approach, they have the same goal as copyright holders in the US and Europe â to make pirated content harder to find in search results. However, unlike the DMCAâs takedown rules and their EU equivalents, this voluntary scheme is currently biased towards large copyright holders involved in video content, with others â such as publishers â excluded. Publishers File Complaints With the Federal Antimonopoly Service Under the umbrella of the Association for the Protection of Copyright in the Internet (AZAPI), major publishers are determined to change this by being heard at the highest levels. Documents obtained by Vedomosti reveal that 15 of the largest publishing houses including Eksmo and AST (which together control 30% of the market), Alpina Publisher, Hachette subsidiary Azbuka Atticus, Mann, plus Ivanov and Ferber, have filed complaints with the Federal Antimonopoly Service alleging anti-competitive behavior by Yandex and Mail.ru. Yandex Should Eliminate Unfair Competition From Search Results Signed by AZAPI chief Maxim Ryabyko, the complaints demand an order that would require Yandex to stop âabusing its dominant positionâ while removing âunfair competitionâ from search results. AZAPI says that while Yandex is happy to support other copyright holders as part of the memorandum, publishers are excluded. This means that Yandexâs search results and indeed its other products (Yandex.disk, Yandex.music and Yandex.video) are littered with links to pirated ebooks and audiobooks. Since they are denied access to the voluntary scheme, the publishers have to keep going to court to have pirate sites blocked. However, when sites deploy mirrors to counter blocking, these sites immediately appear in Yandexâs search results, undermining the work done thus far. Mail.ru Allegedly Discriminates Against Some Rightsholders Mail.ru may not be as immediately recognizable in the West as Yandex but its power in Russia cannot be understated. As the owner of social media giants vKontakte, Odnoklassniki (Classmates) and Moi Mir, plus numerous other services, Maril.ru is a major player. As a result, AZAPI accuses the company of abusing its position, including by creating discriminatory conditions for copyright holders. In 2019, vKontakte implemented finger-printing technology that allowed publishers to identify and remove pirated copies of eBooks. While this was a step forward for the publishers, they are now complaining that despite their calls for cooperation, Mail.ru is resisting deployment of the same anti-piracy system on its other platforms. Pirated Content Helps Yandex and Mail.ru Stay Dominant Copyright owners have long accused Internet platforms of indirectly benefiting from piracy. Itâs a claim now repeated in AZAPIâs complaints, which allege that Yandex and Mail.ruâs discrimination against publishers help them to maintain both a dominant position and user loyalty. âFor many years, illegal content has been an important tool for attracting new users and maximizing the reach of the Russian-speaking audience for social networks, creating a so-called network effect,â AZAPI says. Complaints Under Consideration The Federal Antimonopoly Service has confirmed that AZAPIâs complaints are now under consideration. In a statement, Yandex said that search engines do not know and cannot determine the legal status of indexed content. Mail.ru, on the other hand, said that AZAPIâs complaints do not relate to anti-trust regulations.
