  1. When you make a movie about Wikileaks, starring Julian Assange in a Pirate Bay t-shirt, you probably know that it’s virtually impossible to prevent pirated files from spreading online. Nevertheless, the movie studios behind both films are trying desperately to take these leaks offline, thus far without much success. Adding to the irony, the Pirate Bay T-shirt used in The Fifth Estate also appears to be “pirated”. Hollywood premiered two films on Wikileaks this year, The Fifth Estate and We Steal Secrets: The Story of WikiLeaks. Like most other releases, pirated copies of both films leaked onto the Internet soon after they came out. In an attempt to stop this unauthorized sharing the studios have been sending out numerous takedown requests. While there’s nothing new about major Hollywood studios sending takedown notices, there’s an amusing irony to this case. The studios are trying to suppress leaked information, much like the U.S. Government tries to stop Wikileaks from sharing its “work”. And there’s more. The Fifth Estate, for example, has their version of Julian Assange starring in a Pirate Bay t-shirt. Not just in the movie itself, but also in the trailer. So Dreamworks and Disney are indirectly “promoting” the torrent site. To our knowledge this is the first time the Pirate Bay logo has been featured in a Hollywood blockbuster. Adding to the controversy, Pirate Bay co-founder Peter Sunde previously pointed out that the shirt was custom-made, and not bought through the official shop, making it a “pirated” T-shirt. Nevertheless, The Fifth Estate rightsholders are not happy with the fact that people can pirate their film on The Pirate Bay and other torrent sites. In recent weeks they have sent out many takedown requests to remove links to unauthorized copes, including this one. Similar takedown notices were sent out by Universal Pictures for We Steal Secrets: The Story of WikiLeaks. Universal has sent a slew of DMCA requests directly targeting leaked copies of the documentary on The Pirate Bay and several other sites. While Google has removed the links in question, the original links are still accessible on many sites. Adding yet another twist to the above, Julian Assange and Wikileaks probably wouldn’t mind if the films were made unavailable. They have criticized both films on several occasions. “I know the film intends to depict me and my work in a negative light. I believe it will distort events and subtract from public understanding. It does not seek to simplify, clarify or distill the truth, but rather it seeks to bury it,” Assange previously said about The Fifth Estate. For now, however, the leaked copies remain available.
  2. Following historic and gigantic cash settlements in recent weeks, starting in the new year the MPAA will take the out-of-court piracy settlement game to a whole new level. According to sources close to the group, the first U.S.-based torrent or file-hosting service to incur Hollywood’s wrath will have to cough up around $2 billion in cash and hand over the blood of their first born child. And play along with the lie that this has any basis in fact, of course. In mid October the long-running dispute between BitTorrent indexing site isoHunt and the Hollywood studios of the MPAA came to a premature and dramatic conclusion. Under incredible pressure isoHunt’s Gary Fung agreed to pay a mind-boggling $110 million to the movie studios and in exchange for all of his legal problems becoming a thing of the past. And then, just this week, file-hosting site Hotfile’s battle with Hollywood also came – wait for it – to a premature and dramatic conclusion. The embattled cyberlocker decided it would be better to pay the studios $80 million rather than have an annoying trial hanging over its head. Unsurprisingly this new-found cash generating plan (which hasn’t paid off so well since grabbing $110m from TorrentSpy in 2009) has the MPAA so excited it’s ready to significantly up the ante. According to sources the first pirate site admin to incur the MPAA’s wrath in 2014 will have to pay a cool $2 billion and hand over a chalice filled with the blood of his first born child. This event will be turned into a movie and subsequently cammed by pirates, with the MPAA collecting successive $2 billion settlements from every site that dares to show it illegally from there on. While the above paragraph is clearly utter nonsense, it carries only marginally less bullshit than the claims that isoHunt and Hotfile together collected $200 million and gave it to the MPAA. Anyone who believes they did might also be interested in a bridge The Pirate Bay has up for sale in London for which TF is currently collecting deposits. These huge headline amounts are there to scare other site owners who might be considering embarking on the same path as Gary Fung and the mystical Anton Titov. For sure, both former site operators knew that but faced with financial ruin they were both forced into settling with the MPAA instead. Who could blame them? Think about it though. They handed over $200 million to avoid being ruined. That suggests that they must have even more money than that kicking around. While Hotfile’s finances might be healthier than Fung’s, the chances of the site having $80 million kicking around are slim at best. And rest assured, isoHunt’s former operator has never, ever had $110 million at his disposal. In fact, when we last spoke to Fung he was far from suicidal. He was cheerfully starting up his own clothing line, even though he was apparently a tenth of a billion dollars in the hole. Last week Kim Dotcom put out a tweet in the topic, hashtagged #insider. He doesn’t believe the settlement amounts either. So what exactly did he mean? “All I can say is that I know the settlement number published isn’t what Hotfile will pay. It’s a PR number the MPAA uses to scare others,” Dotcom told TF. “From what I have heard about how the MPAA does it in their settlement agreements is that they require the site owner to agree to a list of activities the site owner can’t do for five years, like start a new similar site.” That’s probably why Gary Fung is testing out t-shirts rather than getting technical with torrents. And if Dotcom is correct, torrents will be a thing of the past for some time yet, if the isoHunt founder wants to keep control of his own finances that is. “When that time has passed the site owner gets a significant discount (often over 90%) and in the meantime the site owner doesn’t have to settle the full amount, but only lets say, 5% of it,” Dotcom adds. The Megaupload founder says the figures put out by Hollywood have no basis in truth and only exist in order to spread fear among others. “So the MPAA can go out there and issue a press releases about these ridiculous settlements, scare the shit out of every site owner that allows user generated content, while getting pennies on the dollar for those settlements. I can tell site owners with confidence that these settlement numbers are FAKE,” he concludes. Seriously – at any point did anyone ever believe otherwise?
  3. This week marks the rollout of the long delayed "Copyright Alert System" aka the six strike anti-piracy program. It's a bit confusing at a glance, but it's not nearly as powerful as you'd think. Here's how the system works, how it'll affect you, and everything else you need to know. The Copyright Alert System is a policy created by the Center for Copyright Information with backing from the RIAA and other copyright organizations along with the major internet service providers: AT&T, Cablevision, Comcast, Time Warner, and Verizon. The group monitors peer-to-peer file transfers, and sends out email notices when it detects you're downloading copyrighted material. On the surface it all sounds a bit draconian, but lets dig into what the Copyright Alert System really does, and what power it actually has. What the Copyright Alert System Does The Copyright Alert System is pretty simple. It's a system that lets an internet user know that their account is used for downloading copyrighted content illegally using peer-to-peer file sharing. When you're caught downloading illegal materials from peer-to-peer networks the first time, you receive an email letting you know that you're doing something illegal, and educating you on the laws of copyright. The second offense may be another email requiring you to acknowledge receipt, or an educational call from your ISP. From there, the ramifications step up. The second level of warnings (third and fourth emails) require you to watch a video before getting online (or a redirect from certain web sites to an education video). The final tier of warnings are for the fifth and sixth infraction. They range from throttling your bandwidth to redirection to a new landing page. Each ISP has a different policy with how they'll tackle each offense, but they haven't shared their plans yet (you'll likely get an email this week outlining your ISPs program). Update: Mashable has the breakdown of how it'll work with Verizon, Time Warner, Comcast, and AT&T. The system starts with content partners (the RIAA, MPAA, etc) snooping in on public peer-to-peer networks to find content they own being shared illegally. When they find a copy, they trace the IP number through the ISP, and forward that information to the ISP. Next, your ISP matches that information with your account, and sends you the warning. Basically, it's the content partners who are snooping in on peer-to-peer file sharing networks, not your ISP. If they find you downloading something you're not supposed to, they're supposed to verify it's a full download before sending the notice to your ISP. What the Copyright Alert System Doesn't Do The Copyright Alert System: How the New "Six Strikes" Anti-Piracy Program WorksExpand First things first: the Copyright Alert System is not a government program. Your ISP won't even give up your personal information to the content partners unless it's required by law through a subpoena or court order. The most annoying thing that'll happen if you get caught is that your bandwidth might be throttled. The Copyright Alert System only monitors peer-to-peer traffic from public BitTorrent trackers. That means they're not looking at private BitTorrent trackers, email attachments, file lockers, or anywhere else. Basically, if you're not using BitTorrent you have nothing to worry about.

We are placing our bots to scene torrents. This means we need members to come forward if they would like a fair shot at uploading p2p torrents.   10. Since Megaupload’s shutdown Kim Dotcom left no opportunity behind in sharing his opinions on Twitter and in the media. In a new court filing the U.S. Government is now trying to use Dotcom’s public appearances against him. The U.S. argues that a recent request from Megaupload’s lawyers not to release evidence in public would be more credible if the former Megaupload boss wasn’t being so vocal on Twitter and close to the media in general. The criminal indictment against Megaupload, Kim Dotcom and his alleged co-conspirators is without a doubt the most prominent copyright case of the decade. Tens of thousands of news articles have covered it thus far, not least because Megaupload’s founder Kim Dotcom frequently comments on the case in the media, as well as on Twitter. While Dotcom has the right to be heard, the U.S. Government now claims that these public statements make Megaupload’s defense less credible. dotcom tweet Earlier this week Megaupload’s legal team protested a secret request from the Government to share evidence with copyright holders. According to the lawyers this one-sided disclosure could bias public opinion. “Permitting the Government to widely disseminate a one-sided, cherry-picked set of facts threatens to improperly infect the jury pool before defendants are afforded any opportunity to present their side of the story,” Megaupload’s lawyers wrote. In a letter sent to the district court yesterday, Acting United States Attorney Dana Boente counters this argument. Among other things, the Government suggests that Megaupload’s worries are less credible due to Dotcom’s close relationship with the media and his many comments and tweets in public. “Defense counsel’s stated concern about ‘infect[ing] the jury pool’ might be more credible if it were not for their putative client’s close relationships with and repeated statements to media around the world,” the letter states. “To summarize Kim Dotcom’s many appearances, interviews, webpages, articles, statements, and tweets about his claims about the evidence, witnesses, personalities, and circumstances in the criminal case pending before this Court would take thousands of pages and many hundreds of hours of video and audio.” The letter continues with several examples of headlines that are featured on the websites of Kim Dotcom and his counsel Ira Rothken. In addition to the tweets and news headlines, the Government also points to a white paper released by Megaupload lawyer Robert Amsterdam, and the book about Kim Dotcom’s life that was published last month. “Perhaps most significantly, there is also a 48-page ‘White Paper’ produced by counsel supposedly addressing the merits and circumstances of the government’s case, called ‘Megaupload, the Copyright Lobby, and the Future of Digital Rights: The United States v. You (and Kim Dotcom),’ and a recent book entitled ‘The Secret Life of Kim Dotcom,’ which purports to provide Dotcom’s version of the prosecution’s case.” The Government then goes on to argue that it’s “strange” that Megaupload’s legal team objects to the release of actual evidence against the defendants, while they appear to be so eager to tell their side of the story in the media and on Twitter. “It is strange then to suggest that the release of records that will become public at the extradition hearing would be any different or that the close relationship between the media, the defendants, and their counsel that has already allowed them the opportunity to present ‘their side of the story’ would be impaired by a summary of some of the actual evidence against them,” the Government writes. In other words, if Kim Dotcom is so eager to tell the world his side of the story, then it shouldn’t be a problem for the Government to selectively release evidence in public. The letter doesn’t note, however, that Megaupload was not given the chance to tell their side of the story in court, unlike the Government. This is one of the main reasons why Megaupload’s lawyers objected to the sealed order to release evidence. It is now up to Judge Liam O’Grady to evaluate whether he should side with Megaupload or the Government on this issue. Whatever the outcome, we don’t expect that Kim Dotcom will be silent about it on Twitter and in the media. If anything, the Government’s recent comments will only add fuel to the flames.

In light of the Hotfile judgement that ended with the company being forced to pay $80,000,000 in fines and either ceasing it's operations or implementing fingerprinting technologies to prevent copyright infringement, file hosting companies around the world are scrambling to sure up their businesses. ScrollDog has been in contact with an MPAA representative by the name of Eddie Hoang. He works within the MPAA's Tech department and advises the company on what software file hosting services should be using to combat copyright infringement. Mr. Hoang stated that after the Hotfile news broke, his office received dozens of phone calls from various file hosting companies inquiring into the legalities of their operations. "I set up conference calls with the individuals who were interested in safeguarding their businesses. These calls were placed on my behalf with one of our lawyers present during the conversations. We advised them that so long as they were compliant and took our suggestions into consideration to help prevent copyright infringement that they would be in good standing with the MPAA. We don't want to have to take down companies in court, we just want to make sure that they are taking steps to prevent themselves from becoming piracy havens like MegaUpload or Hotfile." After speaking with Mr. Hoang, we decided to do some of our own inquiring within the file hosting industry, to see which, if any, would be implementing this type of software. Most of the companies that we spoke with were either oblivious to the fingerprinting technology being required in the Hotfile case, some, however acknowledged that they would be applying fingerprinting technology to their services as soon as January of 2014. One of the file hosting companies that we spoke with was Letitbit.net. Letitbit, which is a prominent file host stated the following: "In order for us to remain a dominant file host for the future, we recognize that we need to make some adjustments today". Letitbit will begin using the MPAA's recommended "VCloud9" software or similar sometime in 2014. Several other file hosts also mentioned that they would begin using the VCloud9 software. The U.S. based UltraMegaBit.com has already began working on implementing the software and says it will be ready mid to late January of 2014. File Hosts Currently Using VCloud9: MediaFire.com, the worlds 152nd most visited site and one of the largest file hosts in the world is currently using the VCloud9 digital fingerprinting software. Since using the software, MediaFire has enjoyed a relatively safe online establishment with zero court involvement. Miraculously their online presence hasn't dwindled. DepositFiles.com also uses the VCloud9 software and it too remains a dominant file host. The VCloud9 software relies on computer analysis to locate copyrighted content such as videos or music. The emphasis behind the software is that each created work is unique. The companies that create the works upload their digital signatures for each file into the software database and then it is cross-referenced at the time of upload. It can also be scanned after it has been uploaded to determine if it is a matching digital fingerprint, i.e.; a copyrighted file. VCloud9 supports wide-ranging applications, including online rights management, content-aware advertising, business intelligence, metadata services, media asset management, automatic content recognition and audio visual search. The problem with this software, just like any other digital fingerprinting software available, is that it isn't bulletproof. YouTube, the largest tube site in the world, is living proof of this. YouTube uses the highly advanced and sometimes overly aggressive "YouTube Video Identification" software to establish which uploaded videos are copyright infringing. This software also protects YouTube from harmful lawsuits and limits the unlicensed spread of copyrighted works. Yet, even after all of the preventative measures YouTube still has millions of copyrighted files available. Full movies are extremely easy to find when making simple searches on YouTube. With the software, file hosting companies such as Letitbit can sure up their operations, while monitoring and restricting some content along the way. Then again, how much of the content is really going to be restricted? The users are the ones who choose which files to upload and the company - even when having advanced fingerprinting software installed, clearly still has the same content readily available. Not to mention, these are only visual or digital measures. Combatting against applications and non-digital works, is an entirely different scenario. Once file hosting companies begin adapting and implement the various fingerprinting technologies available, will the MPAA lose their greatest argument in court? Pirates are clearly able to maneuver around this software, it's quite obvious that this is just a vicious circle. Perhaps instead of trying to kill pirated content, the MPAA and similar agencies should try spending more of their time and money on figuring out ways to capitalize off of it. After all, it's he who laughs last who laughs loudest. As things progress we're going to see more and more companies sure up their operations to prevent Hotfile or MegaUpload ordeals from happening to them. Then what will be the basis of a court appearance? How can a judgement be passed down then? After all, it is the MPAA who recommended this type of software in the first place... VPNs are used by thousands of people every day to keep their online activities private and as long as their provider doesn’t log, the theory is that no third party will be able to track a person down from their IP address alone. Thanks to information recently posted to the ChillingEffects repository, we can now see real-life examples of VPN users avoiding costly settlement disputes with anti-piracy companies. spyUS-based Internet service providers receive DMCA notices from movie and music companies when their customers share copyrighted material without permission. Since the ISPs are legally obliged to pass these notices on to the supposed infringers, companies that try to turn piracy into profit see this as a business opportunity. One such outfit, US-based Rightscorp, sends out DMCA notices but tags settlement offers onto the end, thus managing to request cash from an individual whose identity they do not know. While this helpfully circumvents the need to obtain a court order, as reported yesterday Comcast has been stripping the settlement offers away. Another way people avoid these kinds of demands is by using an anonymizing service such as a no-logging VPN service, such as those listed here. When these companies receive Rightscorp-style notices there is nothing they can do with them, since they do not know the identity of the user in question. While VPNs work in theory, up until now there has been little public proof that these services really do stop anti-piracy outfits in their tracks. However, thanks to DMCA notices submitted to Chilling Effects by Proxy.sh, we now have evidence that users are avoiding expensive copyright settlements by using a VPN. The notice below shows a DMCA/settlement demand from anti-piracy company CEG TEK sent on behalf of porn giant Manwin. In addition to the standard takedown text it requires the user to log into their systems and agree to a cash settlement to make a file-sharing lawsuit disappear. Of course, that’s not going to happen because the intended recipient was using a no-log VPN. After following the links and entering the username and passwords detailed above, a TF reader sent us the following screenshots of the settlement offer itself. At this point the user is given the opportunity to enter more infringement notice details if they have them, with each adding to the total settlement amount. Once completed and following a click of the ‘continue’ button, a new page appears asking the alleged infringer to enter his personal details and select a payment method. Further settlement notices sent by CEG TEK on behalf of other copyright holders including porn outfits Brazzers (1) and Celestial (1), (2), all reveal demands for cash. Since none of these were passed onto the VPN user, none of this companies will be receiving a penny. Also of interest are several other notices sent by HBO, Viacom, Warner Bros. and NBC Universal to VPN users. While none of these ask for cash payment, these companies are partners in the ‘six strikes‘ campaign currently underway in the United States. If the individuals targeted by these notices had been using one of the participating ISPs, they would have had a ‘strike’ placed against their account. Since they were using a no-logging VPN, the notices dropped into a black hole.
  15. A new report which concludes that the notice and takedown provisions of the DMCA are no longer fit for purpose cites some interesting statistics from Hollywood. According to the brief the MPAA studios sent more than 25 million copyright notices during a six month period this year, with more notices being sent directly to sites than were sent to search engines such as Google. Despite the massive scale, just eight notices received counter notifications. According to a new report from the Center for the Protection of Intellectual Property at the George Mason University School of Law, the notice and takedown provisions of the DMCA are no longer doing their job as intended. The report, titled The Failure of the DMCA Notice and Takedown System: A Twentieth Century Solution to a Twenty-First Century Problem, states that the 15-year-old legislation’s Section 512, originally intended as an emergency measure to get content taken down quickly, is now “straining under the weight of a blizzard of notices, as copyright owners struggle to abate the availability of infringing copies of their most highly valued works.” There can be little doubt that sites and service providers, especially those that deal with user-uploaded or generated content, are today having to deal with more complaints than ever before. While the RIAA and MPAA have always been in gear, over the past couple of years thousands of copyright holders have become aware of their right to send tens, hundreds or thousands of notices each month in order to have unauthorized content (or links to that content) taken down. But as the report points out, it’s a largely unproductive task. “Despite all the notice, there is precious little ‘takedown’ to show for it. Unless a site employs some sort of content filtering technology, the same content typically re-appears within hours after it is removed,” author Bruce Boyden writes. “As a result, this is a system that makes no one happy. Copyright owners are unhappy with the amount of expense and effort the system requires for such paltry results. Online services are unhappy with the burden of having to process and respond to all of those notices. Users are unhappy with inconsistent enforcement and occasional, inevitable mistakes.” As highlighted in the shutdown of file-hosting service Hotfile this week, filtering is something that the MPAA, RIAA and even the courts are interested in if the circumstances are right. The supposed $80m settlement with a filtering condition imposed was designed to send a clear message to US-based hosting and linking companies, over and above their established DMCA obligations. Nevertheless, in the meantime it’s largely business as usual. Copyright holders are sending out millions of notices every month in an attempt to stem the tide, many of those to search engines such as Google and Bing. Google’s Transparency report reveals all of the copyright takedown notices the search engine receives every month from a wide range of rightsholders, but discovering the numbers sent to sites in general is an almost impossible task. What today’s brief reveals, however, is that the notices sent to search engines are only half the story. The report contains details of the notices the MPAA studios sent in total during a six month period this year. Starting in March 2013 the Hollywood studios sent takedowns for a total of 5.13 million URLs. Just over 2.7 million URLs were sent to search engines such as Google and Bing while 2.36 million were sent to the sites carrying or indexing the infringing content. During April the the movie studios sent less notices – around 4.83 million – with the lion’s share going to search engines (2.85 million) and the remainder (1.98 million) being sent to sites. In May the quantity of overall URLs dropped again to 3.46 million URLs, however the number of takedowns being sent to sites exceeded those sent to search engines, 2.16 million versus 1.3 million. June saw a total of 3.37 million notices issued with around 400,000 more takedowns going to sites than search engines. By July total takedowns were back up to 4 million URLs, 23.4 million to sites and 1.65 million to Google and friends. Just over 4.4 million were sent in August, with just under 600,000 more notices going to sites than search engines. During the total six month period (March to August 2013), the MPAA studios sent takedown notices for 25.23 million URLs, 13.23 million to sites and 11.99 million to search engines. It should be noted that the report doesn’t indicate whether the content taken down from search engines is the same as that being taken down from sites, but it should be presumed that there is some, possibly a lot, of duplication. There is also no indication of the success of the notices sent to sites, although Google and Bing will have complied on most occasions. Finally, of particular interest is the amount of opposition Hollywood encountered when applying for the URLs to be taken down. According to the studios just eight of their DMCA takedown notices were contested with DMCA counter-notices. That doesn’t suggest that in excess of 25.2 million were entirely accurate, but it does show that in the main there is no appetite to have links restored on any grounds.
