  1. Less than a week before the trial between file-hosting service Hotfile and the MPAA was scheduled to start, both parties have agreed on a settlement. The movie studios wanted up to half a billion dollars in damages but settled the case for $80 million. Hotfile will be allowed to stay online if it starts using filtering techniques to prevent copyright infringement, but with the sudden disappearance of its “premium” subscriptions its future is uncertain. As one of the most used file-sharing sites on the Internet, Hotfile has been a prime target for Hollywood. February 2011 the MPAA filed a lawsuit against the file-hosting service. Since then they have been battling fiercely in court and after some delays a trial was scheduled to start next Monday. However, as in the case against isoHunt, the MPAA has decided to settle the case before a jury can decide on the matter. A few hours ago the movie studios announced that they have signed a $80 million settlement with the file-hosting site. The countersuit, where Hotfile accused Warner Bros. of abusing its DMCA takedown procedure, is believed to be dropped as well under the agreement. The settlement deal was rubber stamped by the U.S. District Court for the Southern District of Florida, and requires Hotfile to shut down its operations unless it starts using “digital fingerprinting” technology to filter out copyright infringing content. The MPAA is happy with the outcome which it says will help to protect the rights of copyright holders on the Internet. “This judgment by the court is another important step toward protecting an Internet that works for everyone,” MPAA boss Chris Dodd says. “Sites like Hotfile that illegally profit off of the creativity and hard work of others do a serious disservice to audiences, who deserve high-quality, legitimate viewing experiences online,” Dodd adds. At this point it is still unclear what the settlement means for Hotfile and its millions of active users. TorrentFreak asked the company for a comment on their future plans but we have yet to hear back. Implementing filtering techniques is a drastic step, but not an unusual one in the file-hosting business. MediaFire, for example, successfully employs “digital fingerprinting” technology and remains the most-used cyberlocker on the Internet. According to the MPAA, it should be fairly straightforward for Hotfile to do the same. “The ‘digital fingerprinting’ copyright filtering ordered by the Court is proven to work and readily available from several commercial technology providers. Major websites and content services have been using the technology for years,” the MPAA notes. The question is, however, whether Hotfile wants to go down this route. The company has removed the “premium plans” from its website and TorrentFreak has learned that several affiliates haven’t been paid out lately, which could mean that Hotfile is preparing to cease its operations. While the settlement doesn’t come as a complete surprise, many people would have liked to see a jury rule on the matter. But perhaps it’s in the best interest of both Hotfile and the MPAA to end the case behind closed doors.

  10. Social networking giant Facebook has been granted a patent to use profile information to analyze whether shared files are “pirated” or not. The data is carefully analyzed using several social indicators including the interests of the poster and recipient, their geographical location, and their social relationship. According to Facebook the patent can help the company to “minimize legal liabilities,” but whether users will be happy remains to be seen. facebayIn common with other sites dealing with user-generated content, Facebook has to battle a constant stream of unauthorized copyright material. When it comes to targeting infringement Facebook has a better track record than its Russian counterpart VKontakte, which may be due to its progressive anti-piracy measures. TorrentFreak has learned that one of the anti-piracy strategies developed by the company uses the social profile information of Facebook users and their connections to others as a factor in determining whether a shared file is copyright-infringing or not. Facebook was granted a patent for its invention today, but it’s not known whether the technology is already being used on a wide-scale. The patent in question is named “Using social signals to identify unauthorized content on a social networking system” and in the introduction Facebook describes the wealth of personal and social information the company can tap into. “”[...] users have been voluntarily divulging more of their personal information, such as their friends, geographic location, preferred television shows and movies, hobbies, and activities to social networks,” Facebook notes, adding that they can also see who people communicate with and who they are connected to. Taken together this is a treasure trove of information, but one that’s currently underutilized. With its new anti-piracy tool, however, Facebook hopes to use this intelligence to predict whether shared content is legitimate or not. “While all of this information is recorded and stored, it has not been used to predict the nature of any content items that users interact with. In particular, the social activity surrounding a piece of content on a social network has not been used to predict whether the content is unauthorized,” Facebook writes. Facebook’s social anti-piracy tool facebook-pirate The patented technology can be used to detect a wide variety of unauthorized content, but piracy in particular is a problem for social networks, Facebook explains. “Some users abuse the content posting feature by posting content items that infringe on copyright laws or otherwise violate the social network’s terms of use. For example, users might use the content sharing feature to post chapters from popular novels, episodes of television shows, or links to web pages on external domains that might contain similar copyrighted content.” By using social signals to detect copyright infringing links and files, Facebook believes that operators of social networking sites can “minimize legal liabilities.” To come to an accurate estimate of the infringing nature of a file, the patented system can use all social indicators available to it, including what people “like” and where the live. “The social networking system may collect social signals about the content such as the diversity of the viewers of the content, the relationship between the viewers and another user or other entity that is featured or tagged in the content, and the relationship between the viewers and the user who posted the content,” Facebook writes. “The social signals are then used to calculate a series of aggregated metrics to generate a prediction for whether the content is an unauthorized use of the social networking system.” The final step is to delete the allegedly pirated files or links, or hand them over for a more detailed review. Facebook doesn’t reveal whether the patented system is already in use or which personal details of Facebook users are considered. However, according to its privacy policy the company can use all available user information to protect “rights or property” of Facebook and others. Users of online underground bazaar Sheep Marketplace are trying to figure out who got away with $5 million, $40 million, or even $100 million worth of bitcoins from the site — and whether it might be the owners themselves. Yesterday, Reddit user CrazeeFruito posted a message from the front page of Sheep Marketplace, which appeared to have been shut down. Sheep is down We are sorry to say, but we were robbed on Saturday 11/21/2013 by vendor EBOOK101. This vendor found bug in system and stole 5400 BTC — your money, our provisions, all was stolen. We were trying to resolve this problem, but we were not successful. We are sorry for your problems and inconvenience, all of current BTC will be ditributed to users, who have filled correct BTC emergency adress [sic]. I would like to thank to all SheepMarketplace moderators by this, who were helping with this problem. I am very sorry for this situation. Thank you all. With bitcoins hovering around $1,000 apiece, that meant that "EBOOK101" had effectively stolen over $5 million from users. Bitcoin owners have experienced serious hacking losses before: last year, exchange site BitFloor had 24,000 bitcoins (then worth a mere $250,000 USD) stolen because of a security hole, and a little over 1,000 bitcoins went missing from virtual wallet BIPS last month. But users had serious doubts that an outsider had really found and exploited a bug, especially after what was described as a week of suspicious behavior. In late November, the site SheepMarketScam.com started warning readers that vendors and buyers couldn't withdraw money from Sheep Marketplace. At the same time, it said that market moderators had started offering bulk drug purchases if people would pay first rather than keeping the money in an escrow account. "ALL DAY, WE'VE BEEN CHASING THE SCOUNDREL WITH OUR STOLEN BITCOINS." "They know Sheep is closing and so they are reducing all prices, introducing new products, and making everyone [finalize transactions early] to try and take as much as they can," wrote the author. And the actual theft is thought to be much higher than 5,400 bitcoins. As noted by Tapscape, Andy Greenberg of Forbes, and others, some people have pointed to an address with transactions totaling a little over 39 bitcoins, supposedly the amount in Sheep Marketplace before it shut down, as an indication that the site's owners had absconded with the funds. On Reddit, a pair of users have worked to follow a trail of allegedly stolen bitcoins as they're bounced around addresses for laundering. "All day, we've been chasing the scoundrel with our stolen bitcoins through the blockchain," wrote sheeproadreloaded2. The money they're chasing, which is still being moved through accounts, is closer to a total of 96,000 bitcoins, and users hope that knowing where it's gone will help identify the thieves if they try to sell or convert their ill-gotten gains. Overall, though, the whole shutdown is a confusing mess, and it's far from clear even how much has been stolen, regardless of who took it or whether this hunt will help solve the mystery. While some hope to track down the people behind the theft, others wonder if the site's owners are starting a new scam. SheepMarketScam.com writes that Sheep Marketplace started linking a service called TorMarket, which the author suspects is run by the same people. TorMarket, however, has disavowed the site and asked its administrators to take down the link. "This is the worst PR we can get right now," its home page reads. For users who moved to Sheep Marketplace from Silk Road after its shutdown by law enforcement, this means another major bitcoin black market is gone, along with their money.

This will by necessity require a complete site re-installation and restore from backups. At this time the backups are being evaluated as the same hardware failure has caused some degree of data corruption in the backups.   13. We apologize for the downtime today and it sadly interrupting the donor appreciation freeleech. In terms of why the site and tracker were down, we had a drive fail. This is usually a non issue thanks to RAID. We submitted a ticket to get the bad HDD replaced, but our host's support team decided not to tell us when to expect our server to be shut off to do the replacement. After they replaced the drive, we had issues with the server not booting and received similar poor support yet again. Thankfully, the RAID array is once again healthy and all data is in tact! Freeleech Extension The freeleech has been extended an extra day! The Beathau5 community and its users are the best around, we couldn't let downtime take away your site wide freeleech. The new freeleech end time is December 05 0000 UTC.
