  16. Video streaming service VidAngel, which allows users to filter objectionable content from movies and TV-shows, has to pay $62.4 million to Disney and Warner Bros. The company is liable for copyright infringement after it streamed movies without permission of the rightsholders. In addition, it violated the DMCA's anti-circumvention provision, by ripping DVDs. Founded in 2013, Utah-based startup VidAngel entered the video streaming market with a rather innovative business model. The company allowed its users to rent popular movies and TV-shows, with the option to filter out violence, sex, profanity, and other objectionable content. While there was plenty of demand for the service, it operated without permission from the major movie studios. Instead, the company acquired DVDs, which it would then rip using AnyDVD, so they could be streamed online. Users interested in a movie were able to rent it for $20, and then sell it back after a day for $19. This made rentals as cheap as $1 per streamed movie, effectively beating all legal competitors. VidAngel made sure that it would have physical DVDs in its archive for all movies and TV-shows that were rented out at any given time. This resulted in a rather extensive library of duplicate discs, as the massive collection of “The Revenant” DVDs below shows. “Thousands” of The Revenant DVDs After operating its service for a few months, VidAngel drew the attention of several major movie studios including Disney and Warner Bros. In 2016, they teamed up to file a lawsuit against VidAngel, accusing it of copyright infringement and violating the DMCA’s anti-circumvention provision. “VidAngel does not have permission to copy Plaintiffs’ movies and television shows or to stream them to VidAngel’s users,” the studios’ complaint read. “Instead, VidAngel appears to circumvent the technological protection measures on DVDs and Blu-ray discs to create unauthorized copies and then uses those copies to stream Plaintiffs’ works to the public without authorization.” VidAngel was convinced, however, that its business was legal. It argued that it was protected by the Family Movie Act, which allows consumers to skip objectionable movie content without committing copyright infringement. The movie studios disagreed and earlier this year were backed by the U.S. District Court for the Central District of California. The Court granted summary judgment, ruling that VidAngel is liable for violating the DMCA’s anti-circumvention provision and committing copyright infringement. The only question that remained was the scale of the damages. This was determined yesterday, following a multi-day trial where the jury concluded that a $62.4 million damages award was appropriate. The bulk of the damages, $61.4 million, is for copyright infringement. With 819 titles mentioned in the suit, this amounts to $75,000 per infringed work, half of the maximum statutory damages. The additional million in damages is for circumventing the DMCA’s anti-circumvention provisions by ripping the DVDs. This cost VidAngel $1,250 per title. The movie studios are happy with the outcome. In a joint statement, they state that it sends a clear message to others who might consider operating a similar service. “The jury today found that VidAngel acted willfully, and imposed a damages award that sends a clear message to others who would attempt to profit from unlawful infringing conduct at the expense of the creative community,” the studios note. VidAngel, however, vows to fight on and is likely to appeal the case. “We find today’s ruling unfortunate, but it has not lessened our resolve to save filtering for families. VidAngel plans to appeal the District Court ruling, and explore options in the bankruptcy court. “Our court system has checks and balances, and we are pursuing options on that front as well,” VidAngel CEO Neal Harmon adds.   17. Epic Games CEO Tim Sweeney says that other digital stores for PC games tend to "fleece" developers. Although Epic Games is known most for its creation of the Unreal Engine and the development of the highly-successful Fortnite, the company announced in 2018 that it would open the Epic Games Store. The idea behind the Epic Games Store is to offer an alternative to the Valve-owned Steam which had a monopoly on digital PC game sales. Steam has spent the past few years under fire by the industry, thanks to questionable policies and business practices. Steam has also faced criticism over how little the site compensates game developers. Even former Valve employee Richard Geldreich stated that Steam was killing PC gaming recently. With Steam being the only big player in the digital PC game store market, most developers took what little they could get from the retailer to have their title listed on the site where an extensive collection of players could see it. That all changed with the opening of the Epic Games Store, which promised more of a cut of profits to developers. Whereas Steam only offers 30 percent revenue share with developers, the Epic Games Store offers a whopping 88 percent. Since the Epic Game Store's launch, Sweeney has been vocal about how he feels other developers get treated by competitors. Sweeney recently took to Twitter to state that he thought that other stores "fleece" developers. Although he doesn't specifically mention it, Steam is certainly qualifies as one of the other stores. Epic Games has proven itself a capable competitor to Steam by offering a series of timed exclusives, including Metro: Exodus and Borderlands 3. The company also recently announced that it will be the exclusive retailer of the PC version of Shenmue III, which angered many loyal Steam fans. However, Epic Games reiterates that although it believes that the idea of exclusives is flawed, they are necessary to win over gamers to the site. The Epic Games Store insists it only has exclusives to create a worthy competitor to Steam and that it will continue to offer them until Steam gives developers a better share of revenue on its site. Sweeney's comments aren't entirely incorrect, but they do add more fuel to the fire that is the battle between Steam and the Epic Games Store. Meanwhile, online PC games retailer Discord is also offering more revenue share to developers. Opening up digital PC sales to competition means that game creators, particularly those that aren't AAA developers, get more of an opportunity to make money off of their games, which in turn, allows them to continue to make games. Healthy competition is not just a win for developers, but for players, too.

To the surprise of maybe one or two people in the entire world, Cyberpunk 2077 will feature multiple endings, as confirmed by quest director Mateusz Tomaszkiewicz during an interview with a YouTuber named YongYea at E3 2019. Cyberpunk 2077 is the latest effort from renowned RPG development studio CD Projekt Red, the company behind The Witcher 3: Wild Hunt and popular online TCG Gwent, a spin-off of Geralt's adventures. Cyberpunk 2077 has been the subject of increased media scrutiny leading up to E3 2019, and not all of it has been pretty. The game has been controversial for its portrayal of race and gender, leading the creator of Cyberpunk 2020, the tabletop franchise that inspired CD Projekt Red's video game, to defend some of the studio's choices. On the bright side, however, the recent reveal of Keanu Reeves as a main character in Cyberpunk 2077 has done wonders for the title, with many excited to see one of the most in-demand celebrities of 2019 lending his talents to a story-driven game. Most importantly, new hands-off demo impressions from E3 2019 have begun to create buzz around the gameplay in Cyberpunk 2077, something crucial in the game's marketing build-up since it's a big departure from the third-person fantasy world that made CD Projekt Red famous. In an interview with YouTuber YongYea, Cyberpunk 2077 quest director Mateusz Tomaszkiewicz confirmed that the upcoming game will feature multiple endings. Tomaszkiewicz played coy about just how many endings would be available, but for reference, The Witcher 3 had several major endings that then fed into even more varied minor endings based on decisions made throughout the game. Given that Cyberpunk 2077 is supposed to be bigger than The Witcher 3, it stands to reason that the game could end up having even more options for endings when all is said and done. The interview also indicated that CD Projekt Red is looking into a Cyberpunk 2077 photo mode, but it might not make it into the game at launch, just like the rumored potential for a Cyberpunk 2077 multiplayer addition that would have to be after the game releases if it ever occurs. The photo mode was previously confirmed by CD Projekt Red last fall, but it appears priorities may have shifted a little during development. It's not a major surprise to find out that Cyberpunk 2077 will have multiple endings, but it is something of a relief—fans would likely have been outraged if there was only one finale available after such a lengthy and choice-driven game. What the inclusion of multiple endings does indicate, however, is that Cyberpunk 2077 isn't abandoning the roots that made other CD Projekt Red games so great, a fact that should keep long-time supporters of the studio extremely intrigued in the development of the first-person sci-fi RPG as it progresses.

I saw The Outer Worlds behind closed doors at E3 last week, and I was going to write about it and tell you how cool it looked, despite the game play demo being a fairly slight 20-or-so minute showing compared to Cyberpunk 2077's near hour-long presentation. Now I don't have to, because pretty much everything I saw has been put on the internet anyway! It kicks off at the 4.30 mark: You'll see one of the game's towns in action, how you can switch allegiances, and how to manipulate characters in conversation by intimidating or charming them. It's got the kind of weird, dark sense of humor that older Fallout fans will appreciate—and generally speaking, it looks like it's tailor-made for Fallout: New Vegas fans. It's a nice demo, but I feel like it would've made a bigger splash at E3 had it been longer, or if it was playable so we could get a sense of how the game reacts to our choices. The Outer Worlds is out on 25 October.
  20. Journey to the Savage Planet is a game that, in some ways, is shockingly similar to No Man's Sky. They both share a similar conceit: the player is dumped onto an unknown planet with only their wits and several high-tech pieces of exploration gear to determine whether or not this particular world is fit for human consumption. There's lifeform scanning, harvesting, the construction of more tools, and survival, too, all elements that were part of what made No Man's Sky so tantalizing before it launched in 2016. The elevator pitch for Journey to the Savage Planet starts like a rehash of the same ground Luckily, it's the details that separate developer Typhoon Studios' first foray into the gaming world from its competitors. Whereas No Man's Sky is sweeping, broad strokes of space exploration, Journey to the Savage Planet is more restrained: there's only one world to explore, and it won't take players nearly as long to unearth many of the title's secrets. There's no space exploration element as a selling point, with the titular savage planet serving as more than enough environment to keep would-be settlers occupied. Most importantly, though, Journey to the Savage Planet has something that other exploration games tend to lack in a pervasive and impossible to ignore charm. During our hands-on with the title at E3 2019, we were consistently impressed by the ways in which the universe of Journey to the Savage Planet establishes itself as so much more interesting than a typical survival and exploration game. The first-person exploration title is housed on the world of AR-Y 26, where an employee of Kindred Aerospace, the fourth-best interstellar exploration company in the galaxy, is attempting to decipher whether its worth settling. There are only four interstellar exploration companies in the universe of Journey to the Savage Planet, by the way. It's those small and dry bits of humor that immediately set the game apart, whether its the game's fantastic script or goofy mechanics, like slapping smaller aliens into a pile of goo or launching them into bigger predators as a distraction. We found more than just laughs on AR-Y 26, though. At its core, the heart of Journey to the Savage Planet is a charming but detailed exploration game, the kind that unravels slowly and satisfyingly. We started out just looking for some fun, punching small aliens along the way, but as we delved deeper into our nearly hour-long look into the game, we found something unexpected: investment. Something about the world grabs you and doesn't let go. There's so much to scan, more to observe, and mysteries that leave players with just enough details to make them want to look harder. The actual game play is also way more intricate than it appears at first glance. In combat, dodging enemy attacks can be crucial, with some of them only exposing weakpoints after a successful dodge. It's kind of like a slower and less-detailed Monster Hunter in that way, since enemies are often an easy way to harvest the necessary components of whatever upgrade is needed. Collecting materials is dynamic, with the most enticing ones in dangerous areas that require wit and reflexes to reach. There's an upgrade system that lets players prioritize which elements of the game they want to focus on, and there's an underlying story about terraforming and human greed at play, too, though we're unsure how deep that runs given our limited time with the game. According to reports, Journey to the Savage Planet appears to be a game that will take around 15 hours to complete. Given that we've only seen one hour, there's a lot that could still go wrong. Maybe the writing doesn't hold up all the way through, or maybe the dynamic and shifting environment becomes stagnant as time progresses. Those hypotheticals shouldn't dull the sense that Typhoon Studios is working with something special, however. The game ticked all the boxes that many wanted addressed in the early days of No Man's Sky, and while they aren't the same game, the sense of wonder that exists when exploring the more refined and restricted world of Journey to the Savage Planet is one that doesn't come around often. With so many major games coming late in 2019 and into 2020, there's a chance this title will get lost in the shuffle. Don't let it. Journey to the Savage Planet has all the makings of a sleeper hit, the kind people will be kicking themselves for not playing earlier once it becomes more popular.
