  5. Grumpy Cat is not happy. Her owners have filed a lawsuit at a California federal court, accusing a coffee maker of exploiting the cat's copyrights and trademarks without permission. In addition to hundreds of thousands of dollars in damages, Grumpy Cat's owners also want control of the coffee maker's grumpycat.com domain name. There are dozens of celebrity cats on the Internet, but Grumpy Cat tops them all. The cat’s owners have made millions thanks to their pet’s unique facial expression. Part of this revenue comes from successful merchandise lines, including the Grumpy Cat “Grumppuccino” iced coffee beverage. The coffee is sold by the California company Grenade Beverage, who also operate the domain name grumpycat.com. The company licensed the copyright and trademarks to sell the iced coffee, but are otherwise not affiliated with the cat and its owners. Up until recently the partnership didn’t cause any problems, but that changed when Grenade announced a new line of Grumpy Cat merchandise. In addition to the iced coffee, they now sell Grumpy coffee beans as well. This expansion violated the license agreement, according to Grumpy Cat’s owners, who just filed a lawsuit at a California federal court to set the record straight. “Ironically, while the world-famous feline Grumpy Cat and her valuable brand are most often invoked in a tongue-and-cheek fashion, Defendants’ despicable misconduct here has actually given Grumpy Cat and her owners something to be grumpy about,” the complaint starts. The cat’s owners explain that they hold the copyrights and trademarks associated with their pet, and argue that the new line of roasted coffee ground products requires separate approval under the license agreement. Grumpy Cat’s copyrights “In late 2015, Plaintiff learned of Defendants’ intent to create and exploit a line of ‘Grumpy Cat’ branded roasted coffee ground products, which would be separate and apart from the ‘Grumpy Cat Grumppuccino’ product line contemplated by the License Agreement,” the complaint reads. Grumpy’s owners informed Grenada on several occasions that they did not agree to the new product line, but the beverage maker went ahead and launched the product anyway. “Defendants were repeatedly told by Plaintiff (both in writing and verbally) that the Licensed Properties could not be used in connection with a roasted coffee ground product,” they write. Pirate coffee? The roasted beans are up for sale at grumpycat.com and are being widely advertised to tens of thousands of followers on various social media accounts. The cat’s owners are asking the court to stop these sales and hold Grenada responsible for various copyright and trademark infringements. The potential statutory damages run into the hundreds of thousands and in addition Grumpy Cat’s owners also want to take over the grumpycat.com domain name, claiming that it was registered in bad faith. Previous requests to sign over the domain name all failed. Whether Grumpy Cat will win this case depends on the exact language of the license agreement and how this will be interpreted by the court. However, Grenade Beverage should be warned, as cats have a tendency to win the Internet.
  6. Internet service providers in the UK have begun blocking around 85 new 'pirate' domains following demands from rightsholders. All six major ISPs will implement the ban which targets, among other things, various clones, proxies and mirrors associated with The Pirate Bay plus major torrent and MP3 download sites. Following a series of High Court orders obtained since 2012, six of the UK’s major ISPs are required to block access to dozens of the world’s most popular ‘pirate’ sites. It started off simply enough, with rightsholders targeting the main domains used by sites such as The Pirate Bay, KickassTorrents, Torrentz, ExtraTorrent and other major players. Soon video streaming portals and MP3 download sites were also added to the equation and the list of blocked domains began to expand at a rapid rate. However, what happened next is perhaps best illustrated by the now popular image shown below. In an effort to circumvent blocks, dozens of proxies, mirrors and clones of all the popular sites began to appear. While not having the credibility of the sites’ main domains, for most casual pirates these provided a simple way to keep using The Pirate Bay and many other sites. As a result, entertainment companies in the UK are now engaged in the largest whac-a-mole game ever seen online. Having blocked pretty much every site’s main domain, they’re now attempting to block every ‘circumvention’ site. The task is not only enormous but never ending. In October alone dozens of new domains were added to the UK’s rapidly expanding blocklist. In November, Hollywood and the labels were back again, taking down another 170 domains. And with December only half done, yet another wave has just hit the UK’s shores. Implemented by BT, Sky, TalkTalk, Virgin Media, O2 and EE, more than 85 domains are in the latest batch. Detailed in full below, it reads like Groundhog Day for the entertainment industries. The vast majority represent yet more attempts to stop people accessing The Pirate Bay and one has to wonder who is winning this war and whether it will ever end. No soon as copyright holders add dozens of Pirate Bay-connected domains to its blocklists, dozens more appear. Making matters worse is that they are both easy and cheap to buy, making domains a temporary and ‘throwaway’ item. Furthermore, since these days all major ‘pirate’ players eventually become demoted in Google’s search results, fresh and relatively unknown proxies make it to the top with greater ease than ever before. The same is true for sites facilitating access to other large torrent sites. The latest batch directly and indirectly targets KickassTorrents, ExtraTorrent, BitSnoop, LimeTorrents, Torrents.net, Monova, Torlock, TorrentCrazy, TorrentFunk, TorrentHound, TorrentReactor, to name a few. Directly or via their clones, imitators, proxies or mirrors, this month various key MP3 sites are also in the firing line. They include emp3world, mp3clan, mp3raid, mp3skull, stafaband and newalbumreleases. All of these sites have been targeted several times before and each time new ways of accessing them have appeared. But while on a top-line level blocking seems almost futile, it will be having an effect. The constant hunt for new domains has the potential to frustrate users of ‘pirate’ sites and as highlighted before, blocking efforts are almost certainly diluting the brand value of major sites. The big question that remains unanswered, however, is if any of this is actually translating into additional sales. If it is, thus far entertainment industry companies have kept well away from making the connection. One might exist, of course, but asking for more aggressive options from government and the courts is almost certainly the preferred strategy.   11. This week the RIAA killed the Aurous music player for good, settling their lawsuit for millions of dollars. While Aurous is now done, Florida-based developer Andrew Sampson has just revived another controversial project, the decentralized torrent search engine Strike. This week Aurous developer Andrew Sampson settled his legal dispute with the RIAA. He now owes them $3 million. While the outcome is a financial disaster for the student he doesn’t plan to crawl into a corner, quite the opposite in fact. His torrent search engine Strike was brought back online recently, serving torrents to the masses. The Strike search engine launched earlier this year and provides users with a tool to find the latest torrents. The site itself doesn’t host any files but pulls data directly from BitTorrent’s DHT. The site’s users can then click on magnet links to download the associated files. When Sampson was sued by the RIAA in October the Strike search engine was also taken offline. Many assumed that this was a legal precaution and that Strike was one of the infringing activities mentioned in the Aurous complaint. According to the RIAA the search engine was “specifically designed to promote copyright infringement on the BitTorrent network, which is notorious as a source for pirated music, movies, games, and software.” Sapmson disagrees. While he has indeed signed a settlement agreement that prohibits him from operating any services that infringe on the copyrights of the major music labels, Strike is now back online. According to the Florida-based developer the search engine operated within the boundaries of the law. People who visit the site won’t see any infringing content unless they specifically search for it. “Strike’s search engine is powered by a blind spider, it can only see hashes, seeders and leechers. This is all the data it collects, from there when a user requests a hash using either our API or the main search interface, information on that hash is fetched and delivered,” Sampson tells TF. “Strike doesn’t offer any actual torrent downloads nor does it direct you to a place to download it. We do offer magnets, but this is just for ease of use,” he adds. Indeed, the search engine doesn’t link to external torrent sites. However, the magnet links have a similar function to torrents and provide enough information to download the files which are referenced in search results. Strike Search Results Still, Sampson maintains that Strike doesn’t encourage any infringement and that it’s mostly a meta data engine. He will continue the project and says that it’s his ultimate goal to create a set of tools that can power a Home theater PC. The Strike API helps with that, with tools such as the remote task manager and the remote control functionality. Technology aside, in copyright infringement cases the legality of a service often boils down to how it’s presented. A neutral torrent client can become blatantly infringing when it’s advertised as the ultimate pirate tool. The RIAA previously pointed out how Sampson “boasted” about the infringing search results pirates could find with Strike, which is something that’s best to avoid to keep out of trouble. What’s perhaps most striking about the whole situation is that the RIAA didn’t make Strike an integral part of the out-of-court settlement. This appears to be an oversight, or perhaps they are not bothered too much about the search engine. TorrentFreak asked the RIAA about their current position on the Strike search engine, but the group did not wish to comment.

The NPD Group, which tracks physical sales for the video game industry in the United States, is ready to announce that the PlayStation 4 from Sony managed to outsell the Xbox One from Microsoft during the month of November, although no actual numbers have been revealed. According to the company, the overall spending associated with the hobby has increased by 2 percent, and hardware has seen a solid boost during the current month, especially for current-gen consoles. The PlayStation 4 and the Xbox One combined managed to deliver more than 2.8 million units to gamers during November, and even the Wii U from Nintendo posted improved sales. Liam Callahan, an analyst for the NPD Group, is quoted by NeoGAF as saying, "8th generation console sales rose by 22% in dollars. 7th generation sales dropped by 76% in dollars, which is sharper than the year-to-date decline of 57%. After 25 months, the combined sales for the PS4 and the Xbox One are 47% higher than the combined sales for 25 months of PS3 and Xbox 360 hardware sales." Sony says it went through its best Black Friday and that the PlayStation Store also had a great month. Meanwhile, Microsoft claims that Xbox One had its biggest November in the United States and that first-party game sales saw a boost of 72 percent, mainly because of Halo 5: Guardians. The Wii U is also seeing improved sales but Nintendo is more focused on the NX than on its current platform. It's interesting to note that the price cuts and bundles that were offered by both companies did have an effect on the market but were unable to give the Microsoft device another month at the top of the hardware chart. Call of Duty: Black Ops 3 did not boost software sales The shift towards digital is easy to see in the most recent NPD Group data, which shows a decline of 7 percent for the value of physical video games that were bought during November. The number one position belongs to Call of Duty: Black Ops 3, developed by Treyarch and published by Activision, ahead of Fallout 4 from Bethesda, but the involved companies have not offered full figures. The final position on the podium belongs to Star Wars Battlefront, from DICE and Electronic Arts, which managed to deliver the biggest first-month sales for a title based on the franchise. The rest of the top ten includes Madden NFL 16 from EA Sports, NBA 2K16, FIFA 16, Need For Speed, Halo 5: Guardians, Assassin’s Creed: Syndicate and Just Dance 2016. Rise of the Tomb Raider, the new title in the Lara Croft-powered series, failed to join the top ten after Square Enix, and Microsoft entered a timed exclusivity deal that means it is only offered on the Xbox One and chose the same launch date as for the Fallout 4. December is another big month for the video game industry, and both Sony and Microsoft have announced that they are offering new price cuts for the PlayStation 4 and the Xbox One for the Christmas period.
  17. Final Fantasy 7 is considered the best one in the series, and it was released all the way back in 1997. Now Square Enix wants to remake the game with the Unreal 4 engine and has big plans for this new release. Very few games get to be as famous as Final Fantasy 7, and it still has a lot of fans many years later. The best that they could have hoped for was some kind of HD remake for the original game, but Square Enix understands very well just how much people want this game to be remade. The publishers announced that it’s remaking Final Fantasy 7 in Unreal Engine 4, which is practically almost a new game. You can imagine just how excited the fans are right about now. Not much is known about the game itself, but a small trailer has been released and it shows a short gameplay sequence. It’s really, really different from anything that’s been done before. Since Square Enix is also in the business of making money, they have some plans for the game that won’t make people too happy. They say that the game is simply too big, for today’s standards, to be released as a single title, so they are going to serialize it. Square Enix didn’t say in how many parts it’s going to be split. Video game developer 343 Industries and publisher Microsoft are planning to deliver a new update for Halo 5: Guardians, called Cartographer's Gift, during the week of December 15, and the community will get access to a range of new options for their controller. The two companies are also ready to offer a fuller look at the new content that will be added to the Master Chief shooter, including maps for Arena and Warzone, social playlists, the new Season mode, and more REQ cards. Gamers who want to improve the performance or the look of their Spartans will be able to get special weapons, more armor, and a range of emblems associated with the past of the Halo franchise. Gold Standard weapon skins and the SPNKr Rocket Launcher are two of the highlights of the Cartographer's Gift update for Halo 5: Guardians. When it comes to the controller, gamers will be able to tweak look acceleration as well as the inner and the outer dead zones, which offers them more ways to make their experience comfortable. The first value is currently set to 3, and gamers who want the same experience as during the beta will need to bring it down to 2 or can choose a higher value if they want to reach max speed when pegging. 343 Industries is also encouraging gamers to test various settings for the inner and the outer dead zones to find a setting that they are comfortable with in the long term. The studio explains, "note that the default values on these parameters are all identical to what we (and you) have been using previously. Therefore, you don’t need to worry about this update changing anything. If you don’t touch them, the game will play identically to how it has." Halo 5: Guardians will get one year of maps for free Cartographer's Gift is the second monthly content update for the shooter, and it's clear that 343 Industries has long-term plans to continue to support the community. Fans will be able to create their environments and modes using the coming Forge set of tools and then share them with the community to add even more variety to Halo 5: Guardians. All maps that will be launched for the game during its first year on the market will be free for all players to keep the community united. 343 Industries is currently getting revenue from Halo 5: Guardians via the REQ card system, which allows gamers to use real-world money to get access to packs and improve their performance in the Warzone mode. The system has allowed the company to increase the prize pool of the coming World Championship to 2 million dollars (1.8 million Euro) as the qualifying process begins before the finals that will take place in Halo 5: March of next year. Halo 5: Guardians managed to boost sales for the Xbox One during the month of October and also had a solid performance in November in the United States, although it failed to give Microsoft another win over Sony.
  19. Bethesda had a “nice” surprise for its fans today. The studio finally released its tepid and rather uninteresting patch for Fallout 4. The update had an unexpected result. The mods from the community were no longer working. Bethesda is usually pretty friendly with the modding community, mostly by not getting in their way. It’s true that the tools used by modders need to be upgraded from time to time to accommodate the new executable, but that’s pretty much it. The first official patch pushed by Bethesda brought a number of fixes, but the community quickly found out that the new launcher doesn’t load the mods. This is not good news, but fortunately, a solution has been quickly published on the official Nexus forums. A user published a few simple steps that need to be taken. It’s worth noting that the Nexus Mod Manager needs to be installed for this to work. Users will have to open the Nexus Mod Manager, launch the game and wait with the launcher opened, re-enable the mods using Nexus Mod Manager, and hit play. It’s no longer possible to enable them with other tools or from the INI files. Since this happened with the first patch, users should be getting ready to see this happening every time. A good solution would be to enable the workshop support for Fallout 4, but the developers don’t seem to be in a hurry to do that.
  20. The Steam Controller seems to be much more successful than the Steam Machines, probably because it's so different. Valve has provided us with a glimpse of the manufacturing process, which just goes to show that they are really serious about this endeavor. Valve's plans are never transparent. In fact, the company is very shy about its plans and we don't usually get the full picture of what they want to do until a few years have passed. The perfect example is the launch of the Steam platform. Everyone hated Steam when they launched it and tying Half-Life 2 to it seemed liked suicide. Back then, you could still buy a disc with the game, even if it was published by Valve. You needed Steam to activate it, and it had to remain open during gameplay. It was madness. It turns out that Valve had some good plan to back up the Steam launch, and they put a lot of faith in it. Despite all the criticism, they knew they had a good product and kept on improving it. The same seems to be happening with the Steam Controller. Valve builds the Steam Controller in the United States One of this first things I noticed when I got the Steam Controller was the fact that on the side of the box it says Made in the USA. That's not all that common, especially for cheap products and there is no mistake about it, the Steam Controller is really cheap if we take into consideration all the features it brings. Valve chose to share a short video showing the building process for the Steam Controller, and if we take a closer look past the obvious cool stuff (the robots building the controller have Aperture written in the side), we can also draw a serious conclusion. Given the size of that assembly line, Valve has big plans for the Steam Controller. It doesn't seem to be something that will be phased out if it doesn't have huge sales.   21. Half-Life 3 is a mythical beast that shows up from time to time to help us remember that Valve used to make great single-player games. Now, a new rumor has been started, but the community is not falling for it this time. A major Steam leak has happened today, and a number of games have been revealed as coming to the PC platform. One of the titles mentioned among them is Half-Life 3, but the PC gamers have been fooled for too long, and they haven’t even flinched at the sight. A new entry in the Steam Database has been spotted with the name Half Life 3, but there are some issues right from the start. The main problem is that Half-Life should be written with a hyphen, and not separately. The other thing is that any developer can create a depo with that name although it’s not clear why anyone would do that unless it’s trolling the PC gamers. This is not the first time when information about a possible Half-Life 3 depo surfaces, so it’s easy to understand why this is difficult to swallow. In any case, it would be weird for the first details about an HL3 release to pop out in a leak about other games. If true, it would be one of the most anticipated games of all time, but we’ll just have to contain our enthusiasm.

Video game developer Rockstar has just introduced a new adversary mode to the Online mode for Grand Theft Auto V, but the studio is already ready to offer information about the next massive update for the experience, which is called Executives and Other Criminals and is set to go live next week for all gamers playing on the Xbox One, the PlayStation 4 and the PC. The official announcement does not offer all the details that fans would like but says that gamers will get new modes and updated options for luxurious apartments and houses, as well as a super yacht that comes complete with crew and staff. Executives and Other Criminals will improve Freemode in GTA Online by allowing gamers to get access to new cooperative jobs, challenges and special abilities, including an option to hire and fire other players from the position of bodyguard. Those who manage to keep the position will get access to a regular paycheck as well as extra RP and boost to their skills that are linked to the criminal organization that they are part of. Rockstar adds, "Organizations can go head to head in Freemode, with new missions that make full use of the latest executive defense options including new armored vehicle variants, the devastating Turreted Limo and the missile defense systems of the Super Yacht, which also comes with its own suite of supporting vehicle upgrades including the new SuperVolito Carbon helicopter and personal watercraft." The modes that will be improved by the launch of Executives and Other Criminals include King of The Castle and Moving Target. Gamers also get access to a new adversary mode called Extraction, which will feature a team of bodyguards that need to locate and extract an executive from a downed plane before an opposing hit squad can kill him. GTA Online will add more weapons and vehicles Rockstar says that it is not yet ready to offer full details about the new options that gamers will have when it comes to transport and to combat gear but plans to deliver some details in the coming days, including the usual Friday stream. All the new content will be free to those who already own GTA V, but there are no plans to deliver it on the older generation of consoles because of technical limitations. Executives and Other Criminals seems like a solid content drop for the open world experience and a good way to make sure that fans have some new experiences to engage with over the coming free time. Rockstar has made it clear that it has no plans to deliver any sort of downloadable content packs for the single-player side of GTA V and that all the resources are focused on improving Online. The mode has managed to attract many of those who bought the title and allows the company to get a solid revenue stream from microtransactions and to make sure that gamers stay engaged in the long term.   23. Tony Hawk's Pro Skater 5 is the latest title in this skateboarding franchise, and it hasn’t been well received by the community. A new patch has been released for it in the hope that it will fix some of the big issues. Believe it or not, Tony Hawk's Pro Skater 5 is actually the tenth game in the series, which seems to be getting worse with each new edition. Tony Hawk games used to be huge a decade ago, but their time has faded, and now they seem a relic mostly. Gone are the days when Activision would take up the biggest space at conventions to showcase their latest skateboarding game, with real tracks and professional athletes. Tony Hawk's Pro Skater 5 was pretty much a disaster right from day one, and it was demolished by the critics and the gaming community alike. On Metacritic, it has a 32 out of 100 rating for the official critics and 1.5 out of 10 for the users. It’s that bad. The new patch for the game is a huge one, and it weighs 7.8GB. The developers have added a couple of new levels, Underground and Wild West, some new characters like Teenage Mutant Ninja Turtles or Tyler the Creator, and the lighting and visuals have been improved for several levels.

Video game developer Bungie has launched one major update for Destiny this week and a hotfix soon after to eliminate a major exploit, but the studio is continuing to stay focused on the future of the social shooter and is ready to offer gamers a glimpse into the way they plan to introduce more content for gamers to experience. Eric Osborne, one of the main community liaisons at the company, explains in a new official site update that his team has thought long and hard about the future and about the best way to introduce new mechanics and modes that can keep the title feeling fresh. He explains that "There’s a whiteboard in one of our meeting rooms filled with scribblings and sticky notes that represent the developments planned for Destiny’s not-so-distant future. Events, activities, content, and features designed to keep you happy, entertained and rewarded throughout the year to come: some events and some activities that will become additions to your Director.” Bungie plans to start the next year with an event and content drop that will be on the scale of the Festival of the Lost that took place in time for Halloween. The second one is set to be bigger in scope than anything that has been introduced since The Taken King expansion was launched, set to arrive before the end of spring. Bungie is also working on another major game update for Destiny and more tweaks to the sandbox, although their exact nature is not yet specified. Osborne is also encouraging gamers to deliver feedback on the recently introduced content and the Sparrow Racing mode to help the company improve the game in the future. The statements from the company seem to suggest that Activision was mistaken when claiming that classic expansions are a possibility for the social shooter in 2016. Bungie is also offering more details on Destiny weapon tweaks The company explains that since the racing experience went live earlier in the week more than 12 million lives were lost, both Guardians and enemies. Bungie is also offering an apology for the fact that it failed to deliver all the information related to weapon balancing tweaks in update 2.1.0 for Destiny in the patch notes. Jon Weisnewski, a senior designer, explains that the list of changes has been updated with more details that should satisfy all members of the community and that more transparency is one of the main goals of the studio. He also says that gamers should not confuse the raw base numbers associated with a weapon with those that they see in the actual game when taking on enemies because there are a lot of modifiers that tweak the values. The designer also says that Bungie is tracking information about the impact of the modifications to the auto rifles and is already planning a future update that will improve weapon balance. The Sparrow Racing mode for Destiny is live until December 29 and offers gamers a chance to get exclusive rewards. Bungie will probably offer more details about the big content drops coming in 2016 after New Year's Eve.
